Jesus.... having a nightmare!!

:mad: Bought a pony from a dealer end of oct.... was unsuitable so we took it back 3 weeks later. Refused to give us our money back and would only give us a replacement.

Week later replacement pony arrived. After a week it was completely unsuitable. Kicking out at anything and everything, would just spin in the arena, hacking was ok. Had the dentist out to it and he said teeth were so over grown they were bulging out sideways!! So teeth done we thought it would settle down. Nope. So called dealer who said they would take pony back but they were ill so would need to wait until they were out of hosp, arranged that pony would go back week before xmas, she needed her feet done so got farrier out on the 20th. Dealer then called to say, one of their yards had closed, could we please get xmas out the way and bring her through on the sunday (30th) after xmas. So we went through with pony.
Pony was fine, dealer walked it over the arena3 times while we were standing, then brought it back in to compare size with another pony and it was fine! Agreed that they had nothing suitable and she would give us a part refund, which we agreed to and they would drop off to us yesterday.

Didn't turn up.

Now today we've had a phonecall to say that this pony is completely lame and my farrier is to blame! So I said I would come back over and collect the pony to be told that this is now an rspca case and they wont be giving me the pony back as it's a cruelty case!!!

I'm going to blow a *****ing stack!!!

Can't offer any advice, but it seems to me the dealer is playing a game with you.
Hope something is sorted out soon.
 
Was it dentist or vet who did teeth?
If vet, get a written note on condition at that point. I'd be inclined to pay a vet to go do a check on it now in their care. You own the horse (presumably you have passport and receipt) so I'd either get in writing from them that the horse has been returned for refund. Or collect horse.

Did you do a vetting?

I'd warn your farrier and get a statement from him regarding the work that he did.

I would be back at that yard like a shot with a phone number for an independent vet to see for myself. Dont tell them, just turn up and kick off.

*******king dealers .. I know you shouldnt tarnish them all with the same brush but they are a bloody liability.

If it was me, would get a solicitor trading standards and myself contact the RSPCA and ask if they can come with you to see said pony - along with a written statement from whoever did the teeth and the feet.

Legally that pony still belongs to you does it not?
 
Can't believe you dropped pony off without being given the refund, sorry. Agree about turning up and kicking off. I imagine they've played this game many times, though, so perhaps call a solicitor too. Was it put in writing that you get a part refund? If not, I wonder if their accounting is 'creative'. Do you have a receipt for the purchase? If so, walk in heavy handed and take the pony home with you. You are still the legal owner whilst this is in dispute.
 
You should try threatening them with trading standards. Else call their bluff and ask to see a copy of the vet assessment of the pony which blames the farrier for the lameness.
Years ago when we returned one to a dealer we arranged for a vet to be present at the handover so there couldn't be any question of the horse being returned sound and in good condition.
 
Yes I still have the passport but they are saying they wouldn't give me it back as it's now a cruelty case!!

I'm just off the phone with my farrier again, he has called them and said he didn't get much sense out of her, but she did say the pony hasn't been out the stable since we dropped her off! And when he asked if she'd changed the ponies feed she replied "it can't be the feed as it's not had any!"

He's just on his way to see the pony but he has a feeling it's laminitis. He thinks because of the stress of moving, not getting out the stable and going from being fed well to nothing has caused the pony to have it! He says it usually takes 3-4 days to present itself which would ring true with me dropping her off day ago!

As soon as your OH is home you need to be in the car on the way to the yard. Forget phone calls, forget emails/ letters ... get up there with as many people as you can (vet, farrier etc) and start kicking off ... Sounds like this is a well oiled routine they are playing and they are having you over and conning you out of money!!!
 
You gave them the pony without getting the cash for it? Wow you are trusting. When I sell horses they don't even come off the trailer until the money is in my hands.

There's a lot of non-important points in your post, stick to the important ones and get yourself a solicitor if you don't have your money within the next day or so.

Knows every trick in the book! This wont be let go and I'll make sure everyone and their bloody dog knows about it! ****ing raging!
They've known exactly what they are doing, put a poor animal in pain rather than just saying we don't have the money sell her on yourself. Furious!

I'd go over too. I'd also get written letters from ALL the professionals who dealt with this pony to confirm the condition of the pony whilst in your care.
 
Sorry reason I was so trusting is they are a large equine establishment in scotland and hold alot of bsja and bd shows ect! Never for a minute did I think they would stoop so low as to cause pain to an animal
 
Not sure, about to call the sspca and see what they say and if they have called them!

I'm so annoyed, we looked after her well! Even though little one couldn't ride her we had groomed and lunged her everyday, she's was on full livery, and the yard owner turned her out and brought her in (morning only) and then at night I put her in the school while I tidied up the stable - so she's not been just stood in at us!
 
I was advised by 'legal advice line' to drop horse off with letter stating my rights and walk off, if money was not given back to go to small claims. So I don't think you have done wrong there, unfortunately this is something many of us go through even with our rights. If you win at court you still sometimes don't see the money:mad: I feel for you, I was awake a lot last night due to a similar situation and I was so livid I didn't sleep! I had contacted a solicitor in the first instance who said under the sale of good act as the pony was not fit for the purpose for which it was intended I was entitled to my money back. She knows this and that is why she agreed to refund me the ££, nothing in writing right enough but there were witnesses.
 
Were both ponies given enough time to settle in, they can sometimes take a while and the way the weather has been, just wonder if you will find the perfect pony that does everything right from the start, good luck.
