Lack of Third Party Liability under E & L Horse Insurance

Having recently brought the E & L Horse Insurance I asked a basic generic question:

'If a third party has a ride on your horse with full consent of all parties given, or maybe if you are selling and the potential buyer is trying your horse and the unexpected happens and they fall and break an arm or wrist and legal action is taken against, you are covered?'

I was a bit shocked at the response as was directly told by E & L that you would not be covered under the public liability section of this policy (Even if the third party have their own cover).

I even rang E & L a second time to clarify and received the same response. I was told really they ought to have their own cover, fair comment on that one, but still nothing to protect you if they wanted to take legal action.

I then found out that not even the Personal Accident cover (more cost) would cover this as only you the named rider are covered then and not the horse. I had heard this company was one to avoid, but they don't make this at at clear even in the small print.

Moral is try asking this question yourself of any insurance company and your be shocked at the answer! Best thing is the Personal Accident part of the Horse Insurance only covers you for death or loss of two or more limbs, so that's at a guess 99.8% of all other injuries ruled out.

E&L do have a bit of a reputation I'm afraid......

You can get good third party liability as a member of the Pony Club, the BHS or as a donor to World Horse Welfare. Far better use of your money IMO.

You'd have to really check your policy! You may well have 3rd party liability related to the property -so if a roof slate blew off and hit someone etc. But I'd be slightly surprised if standard house insurance covered equine third party. That said almost all forms of standard third party insurance are really cheap so it is possible on a high value policy. Better to check than find out too late the liability relates to the property and not the horses. (Unless of course horses are kept at home?)

I always thought third party was related to situations like your horse escaping and causing an accident, kicking a car on a hack etc. Someone else falling off should be covered under your personal accident section - most policies cover anyone who you have given permission to.
I have my third party from bring a BHS gold member rather than through my horse policy. I also get my tack insurance via the sport equipment section of my house insurance as its cheaper, better and has less conditions attached to making a claim. I just use horse policy for death/ theft / straying, vet fees and hospitalisation.
