legal advice re recovery of money

Need some advice on recovering some rent owed to us from previous lease holder on our old business.
I have sent a invoice with details of amount owed period etc asking for payment within 14 days and advised that we will be in contact with our solicitors/courts if balance isnt paid in full.
I dont feel that there is anyway we are going to recieve payment of any kind .What is the best way to move forward .Should I make enquiries with debt collection agency or solicitor.
The amount owed is quite substancial and is causing us problems so quickest way is preferable.
Any ideas or help would be appreciated thanks for looking:)
 
I would use a solicitor and take them via the civil courts, however it might be worth contacting the insolvency agency to find out if they, or the business has gone under. If they make themselves bankrupt, you won't see the money. If they have gone under/bankrupt, you need to contact the insolvency agency and list yourself as someone owed money by them.
 
Thanks thats helpful.There are two partners one has gone bankrupt the other is still solvent.Feel quite angry that our solicitors havent even advised us to contact insolvency agency.
The business is coming back to us as there is aga agreement and we were previous tenants(pub) everything is so long winded with solicitors :confused:
 
depending on the value of the claim i would go down the small claims route esp if they have breached their signed contract! good luck. you can een do small claims on line, depends as i said the value of the claim. good luck.
 
If they are a partnership not a Limited Company then all three partners are liable for the debt, both jointly and severally. Therefore despite the fact two of them have declared themselves bankrupt you can still pursue the third one. (Also contact the Official Receiver re the two bankrupt ones to log your loss with them).

Some solicitors specialise in debt recovery on a no win no fee basis. DON'T go for the ambulance chasers who want money from you upfront and then vanish like a puff of smoke, make sure you use an established firm with a good reputation.
 
You need to quickly take some legal advice before doing much more. Why can't your solicitor advise on this? Have you thought about contacting the company that insures your business?
 
Am assuming that you were tennants sold the pub and under the clause if in the first year, they do not make rental payments profit etc, you are liable and have to take the business back?

If through a Pub Co you need to get urgent legal advice as there contracts are so normally watertight. Also if one partner has gone insolvent was the lease in both names or one as to be honest you are not going to get your money back as a creditor.

I am using reputable solicitor just generally feeling very frustrated as there seems to be no sense of urgency with him and this has been going on since xmas.:(
