Legal Advice....with holding horses/goods

I am leaving a livery yard and have tried several times to collect my horses....the owner of the yard will not allow me to collect my horses and is trying to charge me £20 per day per horse full livery as she is looking after them and not allowing me on the yard....(police have been involved and say its a civil matter so need a solicitor)....i am happy to go and collect my horses but she wont let me...so how can she charge livery?
where do i stand, can i just go and collect them and my goods as she is with holding them from me!...surely thats theft?
 
Do you owe her any livery charges apart from the charge shes saying from holding them
now?
 
I owe her a weeks livery which I have offered to pay no problem and she knows this!, but she is saying she wants proof of ownership of horses..i have the passports for all 4 horses...
 
How awful for you, if there is no reason at all why she should keep them & not allow you to your horses. I would turn up with what you owe & I would get my horses & if she calls the police so what just take their passports, I couldn't care less if I had to drive through the gate, but I would be leaving with my horses even if it did leave her gateless :p

Looks like you'll have to get a solicitor...

..or go with a group of friends and just take them. That's what I would do.
 
What a nasty bit of work, I seem to remember that horses are the one chattel that can't be held in lieu of payment, I had a YO lock my horses in years ago when I gave notice
 
Sounds like there's more to this than you're letting on. Why would YO want to keep your horses unless it was in lieu of a large outstanding bill?

If this isn't the case, I'd turn up with some hefty friends and take my horses.
 
Are you a member of the nhs? Or know someone who is they have a legal advice line that may be of use. Keep a record of time and date of every conversation and what was said
 
If all you owe is a weeks livery, just go and take your horses and leave the money. Have you paid your notice period? Can't help but think there's a bit more to this than you've said.
 
Has she barred you from the yard and is it her property? Or are you allowed on the yard but she's saying you can't bring a box on to collect them?

If it's the former, I believe it would be trespass for you to set foot on there and she could rightfully call the police to have you removed/arrested...

Do you have friends/family who can help? Or friends who also livery on the yard?

What proof of ownership is she expecting and does she say why?
 
I collected a horse once for a lady and the police DID attend. The horse had been sold whilst on loan and lady I collected it for (the real owner) contacted the police and they escorted us. She had passport and photographic evidence of herself with the horse.

I would inform the police you are going to collect your property and if the YO acts in a threatening way towards you, you will need police support.

I would definately go to yard with trailer, passports, cash to pay outstanding livery and get my horses.
 
there is nothing more to the situation...she has plenty of money and thinks i am in the wrong, she keeps changing her story and reason to why i cannot collect them, i dont have a problem in paying what i owe, but will only do so once i have got my horses, they all belong to me and i have the passports, i have transport to collect them straight away, she is just barring me from the property and said she will call the police for trespassing.
All i want to do is get my horses, pay and leave.
 
If you are the legal owner of the horses and can prove it what are you worrying about. They are yours not hers and you have the right to remove them. She is entitled to what you owe and needs to give you a receipt for any payment made. If she threatens to call the police while you are there then let her - providing you actually have nothing to hide???

What are her explanations of you being in the wrong and what are the reasons for not letting you collect them?

Is it that it is not convient for her or more notice needed?
Do you have a contract and what does it say in there about leaving?

It seems a bit strange and odd behaviour from YO, sorry you are in this situation and hope it is sorted fast. Good luck

Just having the horse pasports unfortunately does not prove ownership. Yard owners sometimes hold passports of horses in their care but certainly don't own.

If you can prove ownership, passport in your name may surfice, then contact the police again & ask them to attend at the time you are going to go to the yard to remove the horses, They should attend to ensure there is no breach iof the peace. Hopefully you will be able to pay the outstanding livery & remove the horses.
 
get it in writing what you owe her, even if its only a tex for back rent. take the money with you, for the back rent, tell the police your collecting your horses, take a friend as a witness for anything said. are the horses chipped. let her call the police. good luck
 
There is no requirement to call the police beforehand, this could cause you further issues. Simply turn up (make sure you are in possession of proof of ownership should the YO call the police) and take your horses. They are your property, your the legal owner? Why would you leave them there?

If you owe something, wouldn't it be better to just pay it first? :confused: then she'd have no reason to hang on to them...
 
Go get your horses. Where my friend keeps her horse the yo had padlocked a horse in to stop it leaving as she owed money. The police were call and they made the yo hand the horse over. The yo then had to chase for money owed. So turn up to collect your horses and stuff and if she won't let you have them then call the police.
