I posted this last night, sorry to be a bore, but thought some legal eagles may be reading this at work! and could give a definitive answer! Couple of other people wanted to know too!!

Do all yards charge for trailer/lorry parking and how much? Friend of mine says her yard doesn't any more as they have a lawyer as a livery and she said something about it being the yard's liability if anything happened to the trailer/lorry if they are charging/making a profit out of parking, can anyone enlighten me?
 
Don't know about the legal issue but I don't get charged extra for parking my lorry at the yard

I would think what your friend said was correct though - if they are charging you for storage they must have some duty to ensure it is safe.
 
I would imagine that they would be as liable as a normal carpark or a parking meter on the side of the road - in other words not at all.
 
I would be very interested to know the outcome of this, and I pay to keep my lorry in the car park at our yard, but had never thought about the legal obligations. Also - out of curiosity - what do others pay to keep a lorry - mine is 7.5tonne and I pay £40 per calendar month.
 
They are only liable to a certain extent if charging- so liable that the parking is accessible and that the ground it is on is suitable for such a purpose, but not if the vehicle is stolen, or damaged by another livery.
 
Well for the livery yard to charge you a fee to store your lorry/trailer would need planning permission as they are storing vehicles just like caravan storage places!

Once they have the planning consent then they can charge-as for who is responsible their insurance company should have them put up disclaimers up inthe car park and also on the contract for storing the lorrys trailers
