my horse has been badly kicked whilst at yard for breaking by the owners horse, should the yard have insurance? the horse had had to have an expensive operation (££££) and need some info as to where i stand?!!!

Not even 3rd party liability cover? BHS/BSJA/BD etc offer legal helpline.
To many possibilities here so I would suggest you speak to an equine solicitor to see where you stand
 
The person in question should have Insurance if he is taking in other people's horses to train. I would also say he is liable as the horse was in his care, this however may be a grey area.
 
Forgot to add, onwer's horse so due to strict liablility would still be the owner.

Hope thta makes sense, I just out of hospital and I think the anasthetic is still whooshing round my system! If you have any hassles, you can get half an hour free legal advice: also check your house and/or car insurance as they have different levels of legal protection.
