Legally where would I stand, breed society not giving me right passport!

To cut a long story short and because I dont want to mention too much detail incase I really stuff up my chances but basically I bought a foal from the sales, the auctioneers gave me the wrong passport for the foal. They gave me one for an indentical breed/colour/age foal so somewhat understandable mix up and my passport to the other foal. I didnt notice I had the wrong passport but a few months down the line I had an email from the breeder of the foal telling me I had the wrong passport, oopps! Not a great big deal though as I thought I would carry on with the one I have until the other people register their foal in their name.

Now, this is where it gets difficult as I have a keen buyer abroad for this foal, they want to get him licensed for breeding purposes so DNA testing, etc will be done so it is important I have the right passport. I rang up the breed society who are aware of the situation and asked what I should do as we both know I have the wrong passport for the wrong foal which is illegal. She said it MAY be possible to issue me with a duplicate but when I mentioned that the said foal will be going off to be used as a stallion she told me she wasnt so keen to issue me a duplicate passport now. Where do I stand? The pony legally needs the right passport but do i have a legal leg to stand on if she wont give me the correct passport for the foal? I am annoyed about the situation as they wanted to pick the foal up on friday and I really cannot afford to keep him any longer.

Is the foal you have microchipped and registered with his breed society? If so, what's the big deal with getting a duplicate passport?
 
Where is your foals actual passport? With the foal whose passport you have? Have it's new owners not registered it? Is there no way of contacting them?

Are you a Gold member of the BHS? I would call their BHS legal helpline.
 
Hi, he is sadly not microchipped as he was registered before the laws came in but yes he registered with the breed society.

The foals actual passport is with the foal who's passport I have yes, so a straight swap would be an ideal situation but they havent registered their foal yet so there is no way of tracking them. He had been sold on again since the sale, the breeder contacted the person who bought him at the same time she contacted me.

I wish I was a gold member of the BHS :( Maybe now is a good time to join.
