Livery aggrement

Hi,i have been at my livery yard for about 6 months i signed the aggrement every thing was fair,had to pay 1 months in advance and pay by DD,which is great for me,now to day i get a e-mail saying everyone as to sign a new aggrement,every thing the same but at the bottom is a bit saying if you dont pay and owe money she has the right to sell your horse,can she do this Thanks for reading

no not the same livery yard i was thinking of. its quite common and tbh, if you havent paid your livery for 3+months then maybe you dont deserve to own a horse as someone else is paying for the upkeep.
 
I don't know if i'd sign an agreement like this...I mean how many months do you have to miss before she sells it? So you could miss one months livery for a very good reason and that's your horse gone? Hmm...perhaps get some legal advice, it's quite an important clause?
 
Written into the contract or not I don't think that's worth the paper it's written on. There are very clear legal reasons why someone can't just appropriate your property and flog it if you owe them money. The YO would have to take it all through the courts first. Peter Natt is likely to be able to advise. There was also a similar post some months ago - not sure how long old posts remain accessible x
