Livery Yard Contracts...Advise pls!!

I have been on a livery yard as a DIY for the past 2 and a half years under a signed agreement. I have chosen to move my horses to a cheaper yard down the road, I came today to give my 30 days notice (as I believe is contractoral and polite) and have been told I have 3 days to leave. Is this right, can they do this, I havent got the time booked off work to move them or there stuff sorted yet and Im panicing to say the least, luckily the yard I am moving to has agreed to take me a month early....Is this legal, I was given no reason, just told I must leave in by Wednesday???? The yard is owned by an estate and run but the tenants (dont know whether this is of revelance). Please, any advise would be most helpful!!
 
Sounds like a bad case of sour grapes to me. If you have a written, signed, binding agreement, then that SHOULD support you should anything come to court. Of course, that assumes that you have fully adhered to your side of the contract. I'm a bit wary of the quality of this contract however, if it doesn't contain anything as basic as the amount of notice either side has to give (you say you "believe" it was contractual and "polite", rather than "as per your contract"). I'd go back and thoroughly check the wording of your contract. Even if the yard have stepped outside the terms of your contract however, it doesn't mean to say that things won't get nasty in 3 days time because the thing with court action is that it always FOLLOWS the events. I'd suggest - after thoroughly checking your contract - you speak to the YM and find out what's going on. Saying that, it could STILL get nasty in 3 days time and if it was me I'd make arrangements accordingly ie either move your horse before the 3 days or make sure he will be safe for the balance of the 30 days. The tenant thing is of no consequence - your contract is with whoever is stated as the other party. In the event that you have paid for 30 days notice but the yard has not adhered to the terms by throwing you out in 3 days, then you should be able to take them to a small claims court for the balance of the amount owing to you but be aware that court action is expensive and the outcomes are NEVER certain. Not a nice time for you.
 
I'd go now. I've seen unpleasant things happen once a yard knows that somebody is going.

Hopefully you haven't paid in advance.
 
Sounds like they have taken you leaving personally rather than as a business arrangement. At least it's light until gone 9 so I'd move after work and leave it to their ignorance

i used to be a YO and contract should say i months notice either side. it seems unfair, but people take it personally, when i had to give up the lease (due to daughter being very ill) i paid for 6 weeks for the liveries to find somewhere else as it was over xmas. i told them personally and gave them a written letter and not one of them spoke to me after that. and i thought they were friends.

Get in touch with the Estate's Land Agent. If the tenants are running a business, and are in breach of any contacts issued then they may well find themselves out of businss pretty quickly.......
 
Thanks for your helpful advise, yes I do pay monthly. Im going to have a word with the estate when I cancel my standing order. Im gutted really, I was hoping to leave on good terms, as far as I know I have adhered to every part of the contract, we even used to go to shows together, they never mentioned any issues either then or now, as for my poor horses who are the victims in all this Im going to move them ASAP - just to be on the safe side!!

I dont want to take them to court, Im more hurt than angry....and its an expense I just cant afford after this....

I hope no one else has to go through this and Im so sorry to the people that have, I wouldn't wish it on anyone - I was up at 5 this morning digging out my stables ready to move! I just hope I can get the time off work with such short notice......

You don't have to take them to court - just speak to the Agents. And then move the horses at the end of the 30 days.

Horrible situation to be in.
 
I was at MY FRIENDS livery yard, muttered about finding somewhere else, in a weak moment said I found a place then was given 3 weeks to get out, the date when my horse would be fininshed on box rest. So I wasted no time and left two days later. Once that has happened the atmosphere is terrible and you are best to get out asap. best thing I ever did!
 
If your contract states that they can ask you to remove your horse at anytime then they can legally give you 3 days notice but must refund your notice money if you paid in advance on your first month when you originally arrived there. I too am a Yard Owner and have this stated in my contracts which were requested by my Insurance company! I wouldn't dream of doing this though unless we had a serious problem with a livery that may cause problem to the other liveries & their horses.
