Hi

Please could you advise me , I have my mare on livery which includes the following

All Yr turnout , a stable , 3 haynets per day 3 bales of straw per wk and basic hard feed twice a day / turnout and bring in .

However my mare has not been out in the paddock for weeks ,has been left in and most of the time i arrive she has no haylage at all , is stood in the corner in muck and I cannot prove she has been out ,as yard owner lives on sight and puts her outdoor rug over her stable rug so I think she has been out !

Today i was fumming and put her out and she bucked and cantered about very frisky and rolled and rolled ,also squeeled , if she was out daily surely she would not behave like that !

I have decided to leave as had enough , signed a contract for one months notice , but I want to leave now as i cannot do another month with out my horse getting what i am paying for .

If he has breeched yard contract am i still obliged to follow my side of the deal through

Please help
 
Do you have evidence that the YO hasn't provided what's in the contract? If you can't prove they aren't providing it - and TBH a horse bucking and squealing at turnout time is not evidence of being cooped up for days - then you'll have a battle on your hands.

Three nets a day doesn't necessarily equal haylage all the time.
Bucking and squealing on turnout doesn't equal no turnout for days - mine does that every day!
Standing in muck doesn't mean not mucked out.

In your shoes I'd try and do a few checks - turn up when the horse ought to be out, even if it means a lunchtime visit - and then raise it with the YO.

If you aren't happy, you should move - but if you want to get out of the contract you need to show (should need to show) you have a good reason.

if you cnat prove any of those thing you're pretty stuck and its going to get nasty and reallty, do you need the hassle?>

You could try asking the YO if you can void the monthly notice but i expect she'll pretty much want paying for the month even if you leave early.

Find somewhere else but If things are that bad and you really cant bear leaving your mare there another month leave early just to get her out but id be resigned to pay til the end of your contract as i very much doubt you'll get out of it without a lot of grief and is it really worth it?

agree about checking the horse at times you're not expected and different times of day in the meantime.

goodluck. Its not fun worrying about your horse when you're not able to be there.

I have been up at various times of the day ,no matter what time i go be it after work at 9am or later on at about 2pm she is in her stable while all other horses are all out in there paddocks,all day till about 4.30pm also my are is a massive roller and is always caked in mud ,she has had cream on her legs as was suffering from mud fever from previous yard ,at this yard she has no mud or signs of rolling what so ever , clean as a whistle ,whenhe was turning her out at first she was coming in with a dirty head , now she is super clean .

After 24 hours in you can imagine the state of her stable ,also her feet are always compaxcted with staw ,and no signs out side her door of turnout ,as she would be leave hoof compaction on the ground whilst moving off ..............just fed up I cant prove it as its my work against his
 
I agree with the others about trying to turn up at odd times to get evidence. However would they actually bother to persue you for Breech of contract if you do leave without a months notice? If they can't even be bothered to turn your horse out I doubt it.

I can even bet that as soon as I left this afternoon , she had been put back in her stable ,maybe Should plant a video camera in there !
 
Why would they leave yours in when everything else is out? :confused::confused: Surely mucking out is more work than turning out?

Not doubting you at all, OP, just wondering. Seems very odd.

In your shoes I'd pay the months notice but move ASAP. I know that means paying double livery, but it's worth it for peace of mind if you can't get evidence to prove they're breaking the contract.

I don't agree with breaking contracts without evidence, but you might get advice to the contrary, this being a horsy contract! :p;)

He is putting the other horses out ,and happy to leave them out all day ,no idea why she is not getting out , he can say she is going out ,if that is the case then why is she not staying out like the others ,why would you fetch one paticular horse in and make it stand in on its own ............ I dont understand it one bit myself , he also uses liveries horse's for lessons and im almost posative the horse owner does not know about it , as she is fussy over her horse , I have seen too much dodgy stuff go on

have you confronted him with your concens?

explain yourself and your reasons for leaving to YO. Call his/her bluff and say their contract isn't enforcable for the month livery if you really wnat to go down that road.
however, you better start collecting your stuff/tack anything of value you have at the yard as if you leave a livery yard on bad terms and they're really as unscrupulous as you think they are dont be surprised if things go missing and they make your horses last few days there miserable.

is it really worth it?

just leave ASAP but explain why and ask for the monthly livery you owe on contract to be voided in these circs.
you never know, pigs might fly.

id just concentrate on getting out if i were that unhappy.

No I told him today I am moving off the yard and he said fine I will start your one months notice from today !

I am going to go up in the mornings from now on and check things out , and if it means using alot of petrol i will go up in the afternoons as well , As you say proof is needed , you can't go accusing people with out evidence , but your gut tells you alot .

As ive said she loves a roll and it is winter , her rug is on her over her stable rug , it is not wet ,or dirty , and she has also been left in her stable like this with a full winter coat and had been sweating , its not a good service for £50 a week , I am basically stressed with it all , this mare was given to me on loan with a view to buy and her owner has lessons with him every wed , I have a duty to please her owner as well as make sure my mare is happy , comfortable and if she is in all day at least has water and a hay net ,she was stood in the corner this afternoon depressed and hot under all these rugs.

£50 a week, for full livery?! That's really cheap, IMO- maybe that's the issue? (not that it excuses him not doing your horse, but he can't make any money off that)

mmmmmmmm I know ,I have texted him now stating that im not staying on , thing is right , my mare is on loan , he said there was hackig , found out its on a 60 mile an hour road with trucks flying past and stuff , So I cant hack out , I cant try my mare , I need to know she is a good safe hack before I pay her owner for her , He goes out on this road and he can't understand why i wont ,but he knows his horses , I do not know much about my mare other than that she is 18 , and had alot of riders in her life , but mostly in the menage .

It is aukward and very scary hacking on an A road with police cars flying past , ambulances , heavy goods trucks , I do not feel safe to do it , if i knew the mare inside out then maybe i would consider it , so there is no hacking , no turn out , and I am paying for those things

It is hard as I do like the guy , we did get on well , untill now ,but hes a dealer type buying and selling and he only needs his menage for clients to try a horse out really , so it is no concern of his , if you get what i mean , the other liveries have a trailer and can go out on wk ends so thats fab , but poor me is stuck on the yard and my mare has now started trying to nap when we head towards the school......................

The £50 I am paying is per week !
 
£50 a week for full livery is dirt cheap, & probably why its not up to scratch. With odd exceptions you get what you pay for, worth bearing in mind when you look for your next yard.
 
£50 a week is cheap for full livery IMO. I would leave asap, your horse needs better care. Take pictures of her in the stable, the state of the stable so you have evidence of lack of care. Get her out of there, tell him you'll see him in court if he starts - that you'll sue him for breach of contract.

I would still want to know why all the horses go out except yours though, that is weird!

I had to leave a yard early in the year - he was on full livery but was being starved (and yard was 40 miles from me so not easy to check). I went every day to feed him for 5 days until my new yard was ready for me, and just left with him. If she had tried to get a breach of contract then I would have thrown it back on her face. In the end she didn't dare, as she knew she was in the wrong.

I am going and I dont care , what he says or does , no I dont loan my mare from him , I went to see her and she was so sweet so i loaned her off a lady who oddly rocked up on this yard to view a pony , and she mentioned to him that she had loaned a horse to someone round here and he said oh right whats her name she told him my name and the name of the mare and he said she is on here , it s was bozare , she bought the pony from him and then she told me she was coming up to him from now on every wed for lessons , he moved my mare from one stable to another , and she was weaving and kicking the door down as she was stressed , i called her owner as i felt she needed to know , as it is her horse ! she did not seem at all bothered , as she is up his A.......se and when i went over to him to say i was not very happy at the level of stress my mare was going through he said oh go home she will be fine tomorrow , dont worry about it. So they are bezzi mates and it seems to me its all about making money

By the way my mare was very very thin in a right state when i got her and part of me bought her out of pitty for her,call themselves horse lovers ! she was a disgrace

I am loaning her with a view to buy ,but not from yard owner , i loan her from a lady ,but tis lady has lessons at his yard ,she is not bothered where i keep her ,we are okay with each other , it is just the yard I am not happy with as I said there is no hacking ,no turnout ect and my mare is living in a 12 by 12 stable 24/7

The new yard is diy with all yr turnout ,stable ect and fantastic hacking

Very strange. Move the mare, forgo the rent, notch it up to experience. If you see full livery for £50 a week, avoid it- if something's too good to be true, it probably is!

yes loaning for now but need to pay her owner for her end of january ,hence the reason I need to get going with her now and hack her out , she is fab in the school but she hates it ,naps ect,so hacking is what we need ,she is depressed from being in all the time and i feel helpless to do anything about it as not my yard ! And I was told that he puts them out brings them in ect.................. I muck out my stable that is not included in the price , the price is for stable ,turnout , bring in , haylage and bedding,and a feed.

I think it is cheap as he has no hacking , and he knew this so he thought up a package to get people on there
 
I totally see why you want to move but bear in mind that you say the new yard has this and that but no doubt thought your current one did too so do make sure you check it out yourself and properly

I don't see how you could have missed the main road when you viewed your current yard! Get hold of a map for the new one and check out the roads and bridleways then go in your car at the times you normally hack to see how busy the roads are

OH about the hacking I was told he had access off the back of his property ,to all the off road hacking ,but once I was on I found out he no longer had it ,as I asked the other liveries. they said you have to hack on the main road.

New yard Ive known for many years , he has just never had space , but one place has come up . I rented a paddock there for 6 years so I know the area like the back of my hand

I just did not want to kep my paddock on any longer due to various reasons , and decided to try a yard, hahahaha sometimes I wish ide stayed on my paddock !
