Livery yard probs - need advise

Hi there,

I have stabled my horses in Alvechurch, no contract but only verbal agreement. I am there for almost 9 months now, rent paid in time always, no arrears. Girl who runs the yard has rented it from the owner of the premises, who lives on site as well. One of my mares is about to foal in the next 4 weeks. The girl who rents the yard fell out with the owner and with all of her liveries because she does not care about the yard, does not keep it up (broken fences, fields not done for spring, she is almost never there, does not look after her own 6 horses) and we dared to complain. All liveries were given notice to leave until 5th of May, because "she cannot stand the hassle anymore". I can hardly move with a mare that high in foal, and not really with a newborn. Do I have some rights?
Oh, if we dare to stay longer than the 5th of May she wants to charge everyone 25 £ per horse per day.

Does anyone have an idea what I can do? Thanks for your advise.
 
Have you spoken to the yard owners to find out whether this 'girl' is continuing to rent the yard from them? If she is not, you will probably be able to come to some sort of agreement with them about staying.

But in the meantime - start searching for local studs to foal your mare down in . Clearly the yard as it stands is less than suitable whether you all get on or not.
 
Could the owner not do something like terminate the lease to this girl? I think your only option is to discuss matters with the owner and see what can be done if this girl is not going to reasonable. But definitely look for somewhere else to go as well.
 
I think its a good idea to speak to the owners and find out whats going on re the yard. Are you in a position to rent the whole yard from them and then sub let to the existing liveries? Maybe the owners have given this girl notice as she isnt looking after the place and wish to take on the liveries themselves and do not even know that she has given everyone notice, it could all be a sort of revenge thing on her part. Let us know how you go on.
 
There are legalities regarding moving mares heavily in foal oin anything less than a true emergency, might want to look those up, however if such a poor yard is it really one you wnat her to foal on? If she's a month off I'd get her moved to stud now!

There would no problem with moving the mare to a safer environment for foaling - even at this stage.
 
I'm not sure who has given you notice the YO or the girl who leases it, but to be honest if the conditions are that bad you would be best moving your mare anyway.
If you do it now she will be settled and her system have time to acclimatise to anything she hasn't met before sso Iwouldget on and find somewhere asap.
If it's the YO then do as suggested above, go and offer to do some fencing and make yourself more attractive a livery.
I do understand why they have said everybody leave, when you put the rent received against what most people spend on buying the land/fencing and supplying water etc, it is very tempting so tell everyone to bu***r off.. A post on here had me seething earlier this week, we have spent £40k on refencing our farm but still have some bits where the fencing is dreadful, quite frankly it's like chucking money in the fire. Some bright spark suggested banning all barbed wire which in places we need to use and replacing with post and rail. Oh I agree bw is awful stuff but until someone invents a similarly priced alternative where our land meets cows grazing and no electricity supply it will stay in use.
I would go and talk with the land owner, because of the foaling date she may be prepared to allow you to stay. I'm sorry you have no legal rights whatsoever to insist on staying.
