Livery yards and electric fencing????

Who is responsible for electric fencing on a DIY yard when owners disconnect it from the mains and no battery backup?
Horses are getting in with each other and no one seems bothered!
Mares and geldings that are seperate are now jumping in with each other and fighting!
I have attatched a battery and energiser between my two, that people seem to think is powering the whole yard.
Came back from a comp today to find my horse had been involved in a fight, luckely not injured but its an accident waiting to happen.
NOT HAPPY!

A livery yard owner has a duty of care regarding the safety of the horses he has on livery, regardless as to wether there is a contract or not.

Having said that, if can't be bothered to maintain the fencing then you can either put your own energiser on the fencing to try & keep your horses safe or move to another yard.

Disputes with yard owners are rarely satisfactorily dealt with by using the law. Normally if you can't come to a satisfactory resolution then it's better to move on.
 
I have the same problem on and off at my yard too....
It is the livery owners responsibility....
it is highly dangerous because not only are they jumping in with each other and maybe causing injurying, they could also get out onto a road and kill someone and themselves!!
I would moan like mad....
I did and the livery owner was extremely good about it and redid most of the fencing as my little mare was jumping out or running through it all the time....
I pay a pretty low amount compared to most people on here so I would def have a good go at the livery owner about their responsibilities!!
 
The same kept happening at my previous yard. Horses getting out onto the road, tangled up in the electric fencing (that wasn't even powered) or escaping through hedges. We did our best to maintain the fencing with what we had and were thinking of moving when another horse got in with mine and kicked him half to death, resulting in a horrendous injury. We moved straight away afterwards but I wish we had gone before that nightmare day.

I carn't bellive how irresponsable some of the yard owners seem to be over simple but basic things like fencing, im lucky that ive got my own place but if i was paying for livery I would at least expect the YO was doing the best to minimise risks to my horses. I would put it in writing that you will hold them responsable for injurys etc if they dont maintain the fences.. if that is a problem for them.. move you are the customer.. good luck hope things work out ok..,
 
Yes! it is quite correct that yard owners or operators have a duty of care to both people and horses on the yards that they operate. They should also have adequate insurance cover including ccc (care and custody). Ask to see your yard owners insurance policies to insure they are insured in the event of a claim being made against them.


The fencing and gates in every commercial yard should be safe and and adequate. By that I mean of a sufficient standard to prevent horses getting out, kicking through the fence line or injuring themselves.

I would suggest that fencing should consist of post and rail and Equi-fencing a type of tight knit sheep fencing which prevents horses kicking through the fencing or getting caught on it.

Once a few yard owners have claims taken against them or get taken to court by owners who have suffered injuries to their horses as a result of bad fencing they will get the message.

However if your yard has deficient fencing I would move on to a yard where the operators take every possible precaution to avoid accidents.
