Loan advice- is this fair?

From my previous post regarding my boy coming back of loan in a bit of a state.
I have advertised him and had over 50 emails on him in 3 days! I only want him to be kept at the yard. A girl came to see him yesterday, he couldnt be ridden as his shoes hadn't been done, but shes coming on Sunday to ride him.
She seems really nice and genuine. (but so did the last one!)

In my last contract it stated 30days notice and she should pay for his keep for the 30days notice. Obviously there is no way the old loaner is going to pay this. :mad:

So I was thinking how to I cover myself from this happening again if this girl takes him on? If however long down the line she decides she doesn't want him, just as his 4 weeks livery is due.
So someone said to me they took 4 weeks livery off their loaner up front, like a deposit so if they leave you in the learch youve got 4 weeks to find a new loaner. Does this seem ok? I was thinking its a bit steep, but then I think if you cant afford that then how would a loaner pay for any unexpected bills like insurance excess.
Any advice appreciated please.
 
Well if it's a full loan and they are paying all the bills does the yard ask for a months livery upfront deposit? If it does then just tell her she has to pay that.

That sounds like a good idea to me, and also helps to prove the potential loanee's commitment. If you have had 30 enquiries about him already, then if this person won't stump up the money in advance, then you are sure to be someone who will.
 
Sounds an excellent plan but get a specialist equine solicitor to check the loan agreement so that it will stand up in court. Otherwise it is not enforcable.

Regarding previous loaner you can always take her to the small claims court. This can be done online.

I didnt know that, something to think about. More so she doesnt do it to anyone else.


At least I know I'm not being unreasonalble now. The Livery yard doesnt ask for a deposit, well not me anyway. But I think I will just incase. Like said, if she doesnt want to she obviously wouldnt be serious about him.

If its a full loan she shouldnt have to pay you any money upfront.She just pays the livery etc. Ive got a pony on loan and never payed any money upfront and Ive also put ponies on loan and NEVER took any money off them.
 
From her perspective I'd be worried abt handing over large sums of money to a stranger in case they do a runner with the cash and the horse... not saying you would of course but someone replying to your ad won't know that. When you rent a flat these days the deposit goes to a special regulated place, the landlord doesn't hold it. Not sure if a solicitor could?
 
I think that whatever walk of life it is, some people will always find a way to bugger off and leave someone else to foot the bill :( Obviously do all you can to ensure they are genuine people with ethics which wouldn't let them sod off like that, such as getting references etc, and I personally think the deposit is a good idea, as long as it isn't too big for someone to reasonably find.
 
You could get a legal contract with a clause or 2 in it. I wouldnt hand money over to a stranger,poor girl doesnt know you from adam. Her parents might refuse anyway.

shes an adult with a full time job, I would probably give it to my YO to keep. But I have been left in the ***** with a good contract, references etc so I'd rather keep him myself if someone isnt willing to pay it.

I do agree its an agreement between her and YO. But the YO is my YO and he is my horse, so if she vanished and left without paying I would be responsible for paying the bill as YO would be chucking my horse out.
 
Just checked YO does take 4 weeks payment, I didnt because a friend recomeneded me. So if she has him, when we drop him off for her she would have to pay YO deposit.
