The pony we are loaning is 23 and I am just making amendments to the loan agreement which I downloaded from the BHS Site.

I am pretty sure that this pony is uninsurable due to his age, if the pony were to pass away whilst in our care are the owners in a position to claim from me the pony's value and who could determine the pony's value?

I want to write something like this into the contract just to safeguard myself - does anyone have any experience?

I would check with an insurance company first. And dont be so worried, most ponies go on into their 30's nowadays! Mine was still hunting (very wildly) at 32!

We had an old one on loan and he went back to his owners just a few weeks ago at 26 and still raring to go. The only insurance we could get didn't cover him for vets fees or illnesses only for 3rd party and if he was hurt due to an accident or something like that. Illnesses regardless of what they are they won't insure for because of age. Pet Plan were wanting to charge something like £13 per month (can't remember exactly as it was about 7 years ago), but nfu charge something pathetic like £3! I couldn't believe the difference and at least then he was insured for riders and if he did damage to someone/thing else.

My old boy is still insured at 23 and my friends is at 25, although there are lots of exclusions. I'd check if I were you but there are people out there willing to insure the elderly!!!!

You can get limited external damage cover for him and some companies will offer colic insurance. You will only get meat money with regards to his value. I have Cairo insured for £1 value and £1,000 external injury, plus the usual any rider, third party, tack etc.

An interesting question. I don't think that there are any insurance companies that would take on a 23 year old and insure against death or permanent injury.

Putting something in the contract as you intend doing is probably the best solution.

If you join the BHS as a Gold member you will get third party/ public liability insurance included with the membership.
