Loaning horses and Passports

Hi,

I've got Parker out on loan and its worked brilliantly (Pat will know this) as the lady that has him loves him to bits and he's got two field buddies who he is now bossing about.

But I've been asked to for his passport as the lady wants to move him about in the trailer and it is apparently needed (I guess its to make sure the horse isn't stolen if they are pulled over.)

I'm just a bit worried about doing is, even though I trust the lady. Its the only thing I have to prove I own him. We have signed a contract but from my business I know contracts aren't watertight.

What would you suggest doing or what have you done in this situation?

Yeah, I dont know about this. To be honest, if I allow a pony out on a pre-purchase trial I keep the passport. Like you say, its the only real proof you have that he is yours! I only hand it over when money is handed over.

Do as Weezy says - photocopy every page of his passport, laminate them and bind them together but also include a laminated note to whoever is checking the horse that the horse is out on loan to *********** and the original passport is in your keeping but will be produced to the authorities if necessary. Also make sure you have both contact addresses/numbers; a photo of both sides of Parker included is no bad thing either.
Of course, you are going to have to hand the passport over so Lesley can have his jabs done but as long as he is signed over NOT to be in the food chain at all, then she doesn't need it to keep a record of treatment so she can send it back when they've been done if that makes sense.

You're right, she does think the world of him!!

TBH: having a passport is not proof of ownership as most socieities say in their bumph, not even if the horse is in your name with them but it does help!

Technically, the passport should stay with the horse, not only for shows but if you need to call the vet out, as they will (should!) expect you to produce the passport, if any drugs are given that require entering in it!

One of my horses is out on loan and the passport is with her,
the passport which was issued by the Horse Passport Agency actually says words to the affect of - the passport is means of identifying the horse and is not proof of ownership.
I have kept all freezemark and identichip papers though.

The passport should stay with the horse as it is needed if the horse is travelling and also incase any vets treatment is needed,

My horse is out on loan and the girl has her passport, the law requires the passport goes with the keeper. It is not proof of ownership. Also if she was dodgy she could soon sell the horse at market and get a new passport on the day.

We have Cairo on permanent loan and have his passport. His one states his owner, but has my OH listed as his loanee and our address.

If someone wanted to, they can easily get another passport - hence the mockery of the present system.

From 28th February 2005 horses moving under the following circumstances must be accompanied by their passport.

into or out of Great Britain
for the purpose of competition or breeding
to other premises to receive veterinary treatment (the passport must also be available to any veterinary surgeon or other person administering veterinary products on the premises where the horse is kept)
to the premises of a new keeper
to a slaughterhouse for slaughter
for the purpose of sale

The passport does not prove ownership, it is the same as a vehicle registration document, it states who it the keeper NOT who owns it.

It should really accompany the horse for the reasons outlined above...but I can understand why an owner may be reluctant to part with it.
