My pictures used in ad, only just sold horse. Help please

On behalf off a friend.
She sold her mare a couple off weeks ago to what she thought was a private home and knocked quite a bit off the price as the home seemed right.
Less than a week later, the mare is back up for sale with the same pics being used ( which is my daughter riding) with a fair amount off money put on top.
I know there is nothing that can be done about that but to use my friends pics??? Any thoughts on this? She's going to ring her once she's calmed down a bit.
 
Get your friend to contact the place where the horse is advertised and explain that they do not have permission to use the photos. Other than that there's not much else you can do regarding the horse being re-sold.
 
Would have thought your friend had copyright on photos. Unless she gave her permission they have no right to use them. Sorry for your friend to see he mare sold on by people after a quick buck.
 
I'd be upset that I'd sold to the wrong people- and got stung by dropping the price so they could make a few quid.
However, taking emotion out of the unfortunate situation, the positives are that the horse is not staying with these people, and secondly, if the orginal photo's show the horse off well, she has a better chance of finding a good home.
Only thing I can suggest, is that your friend takes the key title words from the ad, ie Stunning dark bay ISH 15.2hh mare,Sparkie, or whatever the description is,and place an ad on the site along with the photo saying that you would like to keep in touch with her owner.
That way, your friend might at least be able to know what happens to her.

Horserider, that's brilliant idea. I wish I'd thought of that last year when the same thing happened to me (except the photograph bit)

So sad, isn't it that such heartless people pose a caring buyers knowing full well that the seller is trying to find a good home. Suppose at least dealers who are open about who they are, are to be commended.
 
You may be able to have the child's photos removed on a child protection basis, we are not allowed to use any photos of our pupils on our school website without parental permission.

But really, the pony deserves a chance to go to a good home.
 
Trust nobody is right. Sad but true. My son has outgrown his pony but he will stay as a pet and tagging along with us on rides as he's done me so well for 7 yrs who knows where he would end up, couldn't bare thinking about it. And I would be so angry if that happened to me I really would be.

Good idea about putting the ad up, will suggest that.
 
They have NO RIGHT to publish your photographs, you ( or your friend, whoever took the pictures ) own the copyright, so therefore would have had to ask your permission.
Whole story sounds a bummer....
 
Well if I was advertising a horse/pony I wouldn't dream of using the same photo of the previous owners or owners/friends child riding the pony/horse, certainly not without asking if it was ok first.

Doesn't hurt to ring and ask them to remove it, perhaps they just didnt't think, maybe if you explain they will understand and remove them for something else.
 
That is so sad and a similar thing happened to me. I sold a show pony for only £250 as a good home was my priority and thoroughly checked out the home (I thought), seeing the premises and the new owner and daughter rider. A month later I got a call from another person who had paid loads more from the sales - it really upset me that they had put him in the sales 2 weeks later, just to make a fast buck.
Excellent idea about placing your own ad about new owner getting in touch with you as it is in their interest as they can find out the history on your pony as well as putting your (your friend's) mind at ease.

I dont think they can use pics if they didnt take them especially of a child, it is despicable buyer did this i sometimes buy to bring on and sell i always tell sellers if i am doing this even though we keep horses for a long time before seling i would never deceive anyone selling to me,

I also always keep them in the loop to horses progress and where it has gone and if seller isnt comfortable with this it is thier choice not to sell to me.

I think an easy way may be to ring up a commercial photographer explain the situation i am sure they will be sympathetic to your situation and could advise you where you stand, this way it wouldnt cost you anything and they may know of any useful loopholes.

Sympathies to the situation with the pony you can only hope it is sold on to a lovely home.
 
there are quite a few pro photographers on here so hopefully someone will be able to explain the legal side of things re. the photos.

i think i would be inclined to ring and ask them why they are selling and basically try to guilt trip them into at least passing on new buyers details. i'll be selling one of my horses soon and i'm so scared of this happening to me :(
