Part Livery - who pays for what?

In our contract it says that if i, my horse or my guests break anything on the yard we have to pay for it.

Is this correct nowadays? I have been on livery before and hadnt had to?

I have never heard of that actually.
I am on part livery which includes stable, hay, putting in feeds, T/O & B/I, muck out, 5days per week.
I buy my hard feed and bedding and T/O, B/I, M/O at week ends.
I use the yards equipment eg. wheelbarow and a horse in our field has broken several fences and barged through gates but the yard has always fixed them and hasn't demanded money from the owner.

I would find out exactly what this includes.

Not at my yard - I pay livery, and if something is broken I don't pay to fix it.

This is what i thought... Coen i am on a very similiar deal to what you are on, except my hard feed and bedding are included. How much do you pay if you dont mind me asking? PM me if you want.

Can i challenge the contract?
 
I don't think it's unreasonable to have to pay for damages but I would also say there has to be a bit of give and take.

For example, your horse kicks a hole in the back of an otherwise well maintained stable - I think it fair that the owner either makes good the damage or pays for someone else to repair. However a horse that lightly chews a bit of wood in the stable I would class as normal wear and tear.

or another example, a horse breaks a showjumping pole - I would expect to replace if the pole was newish and in good condition. If the pole was old and rotten I wouldn't.

Agree with this.

If your horse/you damage something that was otherwise perfectly good i would expect to pay for the repair of it.
 
Well it is £72.50 per week
I then pay £4 pw for lights as I use the school at night and £4pw for extra hay as my horse is a poor doer.


You can certainly challenge the contract, they don't have to change it but it will give you the opportunity to clearly define what this damage includes.

I suppose compromise is the objective.

How much are you paying all in?
 
I pay £430 pcm, for 5 days - DIY at weekends. That is everything all in.

Ok thanks everyone - this is helpful. I will re read my contract and see if i can get it tweaked as to what exactly is involved.
 
I agree with the wear and tear, horses being horses stuff isnt payable, but if the horse goes berserk and kicks in 5 stable doors then it is!

Can be tricky if YO view of condition of thing horse has kicked is different to owners but generally works.

Otherwise damage that is pretty unusual ends up being paid for by all the other liveries in their charges as YOs generally not going to absorb it and reduce their normally modest earnings from the yard to pay for it!
 
Both the contracts I've had with different yards have said that you break it, you pay, which tbh is fair enough. However although I've offered (my horse has a tendancy to chew fencing :S) the YO has never actually taken any money for damages.
 
my previous yard had this in the contract and when he did break some fencing/stable I was charged materials and prof time to put it all back up (prof time was £40 p/h!!) New yard does not have it in the contract but I would expect to pay a reasonable amount! Just check what you will be charged for as I was charged for 2hr prof time to put an electric fence back up!!!!

New yard is £420 a month 5 day part - this includes all hay, feed, bedding etc ad lib.
