passport and loaning

ok so someone is coming to look at my little pony this week and wants to loan before they buy her however they live in linconshire and i live in the midlands so she will need the passport with her to travel but do i leave it with them? she also wants to take pony to the beach which she would need to travel in trailer. When i loaned my welshy i didn't have the passport but we were only 10minutes down the road from where he used to be obviously i will have a loan agreement writen up but i don't want to loose the pony
 
I would keep your passport once it is at theirs. I don't believe you need your passport with you when 'travelling horse to exercise', so they won't need it to go to the beach.
 
I personally wouldn't do loan with a view to buy for someone living that far away. What if they spoil the pony and then give it back? There are just too many horrow stories on here for me to enter into that sort of arrangment with someone that I couldn't keep an eye on locally
 
The Passport HAS to stay with the Loaner.
You could contact the PIO and inform them that unless you contact them again, there must be no change of Ownership.
 
I have little orange one's passport while she is on trial to me- but thats because the trial is 3 months long. The Loanee does not need it for taking horse to the beach and if its a short loan should not need it at all- so once delivered (give them a photocopy) then take passport with you....
 
she will be staying with them for about 3 months so will a photocopy be ok? thanks trundle and donkey mad ill get onto them!

Hiya I know this person is looking at loaning with a view to buy but have you had any sort of loan agreement drawn up?
There is a very good one you can tailor to suit you and the loanee on the BHS website.
I'm just thinking that because the horse is a few hours drive away then to have something in writing would help so that you both know where you stand.
I loan my big lad, I have his passport and a very good loan agreement which was drawn up by me ( from the BHS website). This agreement was read and agreed by the loaner and was duly signed and witnessed by two other people in our presence. I suggest that you do the same and have a friend to go with you when the horse is delivered and suggest to the loanee that she have someone to act as a witness there as well.
Having an agreement will give you some peace of mind and should anything go wrong and by having witnesses to the transfer and agreement should help.
I am no legal expert and I understand you can have legally bound agreements drawn up by a solicitor if needed. However if you check out the BHS website with regard to loaning and take on board advice it gives it may help.
Have you considered a time period for your loan? Is it a month, few months, 6 months or a year? All this needs to be sorted out with paperwork ideally.
I am not 100% sure on this but based on what information I read before taking out my loan horse I was of the understanding that there needs to be consent by the owner for veterinary treatment etc. I had this drawn up on my agreement and I keep a copy of the loan agreement with his passport so that I can produce them both if the vet asks to see it.
I don't know maybe it is just me but I would never consider lending anything that was valuable to someone without some form of witnessed paperwork.
There are many honest people out there but equally there are very dishonest people. Anyone remember the nice lady on here with the horse Trojan who loaned her horse to someone out of the area she lived in which was then sold on when the person actually got the horse. Woman was later arrested as she had pulled a few other scams involving horses.
I spoke to this lady in person at the time it all happened and she was very upset and angry by it all. I would hate for anything similar to ever happen to anyone else.
My own point of view is don't trust anyone no matter how nice they appear. Get a loan agreement drawn up and witnessed. Check out the address and contact details of the loanee. Visit if at all possible beforehand. Obtain photographs of the loanee when they take the horse or it is delivered.
Perhaps people may think I am going ott with my comments but I would much rather be ultra safe than sorry.

A photocopy will be ok as a reference point- but if during the loan the pony needs its vaccs doing or anything else that might requite some identification then you sould hand the passport over- or one thing that a friend did was to get a duplicate issued from the passport office and they did this for a fee and stamped duplicate allll over it, but it was legal for transportation purposes and any treatments could be entered into it. You could call the passport office and see if they are willing to do this. What it does mean is ownership cant change in it because its a duplicate copy.
 
thanks cazee34 i have asked if she is willing to sign a loan agreement and she said she is she is also bringing identification with her and i have altered the loan agreement on the bhs website to fit in with my situation and i do understand what you are saying which is why i was asking whether to let her passport go with her as i dont want to loose her
 
and she is picking her up as i have no horsey transport i will defo go and check on her while she is there and talk over the phone to check how everything is
 
No probs anytime it's just that when I loaned my horse I was concerned for both parties.
In my case I didn't want to to end up losing the horse through no fault of my own as I have read about horses being loaned out and then suddenly the owner wanted it back with no warning. I get attached to animals very easily, especially horses so I wanted a loan agreement to protect me.
I also wanted the loan to be above board and so that I could show the owner that I was trustworthy, competent and was thinking of the horse's best interests because there could well be a time when the horse may need emergency surgery or treatment and I wanted the protocols to be in place just in case so the horse would not suffer due to 'red tape'.
That is great that she is willing to sign a loan agreement and I would also get a witness for you and her though as well so that you both have witnesses to the agreement.
I don't know if she is insuring the horse but I know in my case I had to send a copy of my loan agreement to the insurer. I made 3 copies which were all signed, 1 for owner, 1 for me and 1 as a spare in case I ever had to send it off for any reason ( ie insurance). I didn't know if insurer would return it to me hence the reason I did 3 copies, they did though lol.
The passport does need to go with the pony but I would make a copy yourself and as Donkeymad suggested notify the passport issuing office that there is no change of ownership just that the horse is going on loan to ....... at .......... Obviously if this lady indeed buys the pony then you can say that the person has now bought the pony and that you agree to the change of ownership etc.
Do you know what sort of ID she is bringing? Ask her to bring some recent utility bills as well as perhaps driving licence passport etc unless she has already said so. I know I offered to produce all that ( apart from driving licence, can't drive and have no passport lol) to the lady when I loaned Doug.
I suppose I am just too cautious and people may think I am silly at suggesting what I have but I have met too many dishonest people in my life that it has made me more suspicious nowadays.
Hope I have not offended or seemed patronising in any suggestions I have made, sorry if I 'came' across in that way.

no i understand completely!! i have always said i would never loan a horse out as i would be scared of loosing them, however this person is really interested and i would like to sell said pony asap (but to a perfect home) and it just means that i don't have to drop my price plus when kids are involved i would rather have pony back if they didn't get along so she isnt passed from pilar to post
