Hi I have just taken possession of a horse many would call a rescue horse,
She was nearly put down at Xmas after going into depression after loosing a foal at the age of 24 and the past 7 years with 2 other foals and 23 hours a day in her stall for the past 2 years. She has Olympic competing history in her past She chose us and we wouldn't changer her for the world.
We've got her to a new yard now and we've seen a huge transformation in her mentally and phycically. From 1 hr outside looking like a patient for a hospice she's now got a field to run around in during the day and now looks like a puppy with a new toy saying hello to all the walkers going past the field.
The passport is my problem. We were given her passport as we drove away. But we were more concerned about her in the trailer. Once we got her settled at the new place we checked the passport to realize it was her old fei passport that had expired in 2007 (they only last 4 years) we spoke to the previous owner and we were given a load of ballony, 2 more times I've had to pester to get it but the last time I've managed to get her to sign a transfer of ownership, a bit more educated about the passport and the information about what she should be doing with the horses passport she'd still refusing to give over the passport. " you've been missed informed by defra" it transpires she wants to keep the passport because she paid a lot of money proving the horses bloodline together with the horses Olympic history so she can sell the horses stallion and gelding for max money. I've never been involved in breeding but I'm sure the other ways of showing the bloodline. Or there may be some other reason I'm not aware of why she doesn't want to hand over the passport.

Going to speak to the bhs today.

As for our big girl I've now got a dog and a horse to share our picnics with

Its illegal for her to hang onto the passport as its illegal for your horse not to have one . I am confused by the FEI passport because as far as im aware they only put a FEI cover on the original passport. Are you sure she is as described?

If the woman will not comply trading standards are your first port of call as they are the responsible agency for equine passports. Do you know who originally the horse was passported with as you could apply for a replacement from them and they will also remind the woman that the passport does not belong to her or indeed you !

Not totally sure about the passport the only horse I have had with an FEI one was as popsdosh says a cover over the original one and it bound together although ours was possibly a bit more recent the horse is now in his late teens so of a similar era.

As for the previous owner keeping it to prove the breeding of the offspring if she is registering them properly with dna testing and passporting in the first year the proof will be in their passports, she has no need to do any more with a well known mare other than to get a copy of the record and use that to promote the youngsters so her excuses don't hold water if there is another passport.

I am also confused by the FEI aspect, I had one in 2004/2005 and it was the normal passport that I sent off and they did something with.

For a pet as you describe I think I would just declare the passport lost and apply for a new one.

TBH, as long as I HAD a passport with her details, I had a transfer of ownership, and she never left the premises, I think I may not notice that it has an expiry date on it. I would always have a passport in case I took a trip and broke down, as recovery companies require them, but I doubt they would check the date.

FEI registration Runs for 4 yrs( Money making) Passport should still be valid however not for FEI competition.

Other than the reason she's given about not handing over the passport because it has the DNA and the horses breeding history, is there any other possible reason why this person would still be so keen to hang on to the passport. I can't think of any.

I've tried on 3 occasions to get.

Getting a new passport which should be an eu one I don't know what office to go to to ask for a copy. There's a possibility between norway. Dutch or German. Hopefully a few more phone calls will get that one sorted.

I have a vet coming to her later this week. Without her passport I don't know what she is up to date with on vaccinations etc. But I think I may have found the vet that has previously seen her.

Yes I realize the passport is the horses not me personally but as far I knew the licence would be sent off with the fee and your name would be entered stamped and returned.

Her history I am sure off and found some competing photos with other evidence , she was brought into the uk in 2005 and her name was changed. The passport I was given was an fai licence with very little info in with an exp date of 2009. I believe it's the licence you would have to allow you to compete internationally and only lasts 4 years at a time. Happy to put a photo up when I get back home.

Checking the bhs site and defra it clearly states that the registered owner has to give the passport to the new owner and it's an offense to transport a horse to a new yard without a licence.
Which I've now committed that offence out of my ignorance

Just such a puzzle as to why the women's so determined to keep hold of the passport.

The breeding excuses are not valid as the DNA and breeding will be held on databases. I would contact the woman and tell her with holding the passport is illegal and that you are giving her one last chance to give it to you before you go to the authorities and report her. If she was competing FEI her name could not have been changed!
You can chuck the FEI paperwork its out of date now and meaningless

I think back in 2005 her name could have been changed, I have had a few that changed including the one with the FEI passport, although it is not allowed now, as she is now retired and not going anywhere I would just ask the vet to arrange to scan for her chip and get one done over here unless you can go back to her breed society and get a copy done.
I don't think previous owner has any valid reason to hold onto it but it may be she has lost it or is just an awkward ****, who knows what goes on in peoples minds.

Again thanks for the replys. I'll be speaking to the appopiate people tomorrow to get this sorted. I'll post the results as it may help someone else in the same position in the future.
The horse will be traveling again soon as we've brought a 154 acre farm in poland on the edge of a 110 sq mile forest where she can enjoy her last year's.
