Passports? Owner? Loaner? Yard Owner? Who should keep it?

Friend has her horse out on loan, and loaner has told her that the livery yard owner insists on having hold of the horses' passports? Is this right?

Surely, if Trading Standards or whoever it is that checks passports were to visit a yard, they would expect the owner/loaner of the horse to reveal the passport, not the yard owner?

Also, that means that if you want to box your horse to a competition and the yard owner is out, presumably you can't take the horse?
 
Passports are supposed to stay with the horse. However, I wouldn't give mine to my YO as it's certainly not their responsibility to hold them.
 
The owner/loaner should have the passport, not the YO!
if the horse goes out on loan then the loanee should have possesion of the passport as the passport has to stay with the horse at all times.

The YO is mistaken if she thinks she should have the passport, if she is really unhappy about not having it then i suggest telling your friend to photo copy the passport and give YO a copy.
 
I wouldn't leave my passport with my livery yard owner, if they wanted to see it they could, would even be happy to give them a photocopy if it was that important.
The loaner should really have the passport
 
id give the YO a photocopy, its hard enough to get hold of the YO for hay etc, if i was trying to get my passport to travel id never get to go anywhere
 
The person who has the horse should have it.

I suppose it is needed to hand if and when a vet requires it?
 
I know a yard like that where the YO keeps passports. Friends horse was vaccinated twice in two days as a result - the YO had a vet out and decided as friends mare was due her annual vacc (she had the passport with vaccs in and could see from that) to have her done to share the call-out. However, friend had already arranged for her own vet to come out and had the mare vacc two days later as the YO hadn't let her know she'd already had her done.

Raises all sorts of issues really. I'd def not ask my liveries for their passports.
 
I was informed by the local visiting council that the YO should keep the passport. I would not be happy about this at all. I would let YO have photocopy as I would with copy of insurance doc.
 
YO should at least have a photocopy of the passport. If you as the horse owner/loaner are legally required to have the passport with the horse when you travel then it is only fair for the YO (and the horse spends far more time at the yard than travelling !!) to at least have some form of proof that the horse has actually got a passport.

the YO can reasonably anticipate to have some jobsworth or other (defra, council, SVS, trading standards, etc etc) come round 'inspecting' and the YO can also be subject to fines.

Copy of insurance - not really necessary as there is no legal compunction to have insurance - it's just a 'wise' thing to have
 
The EU wants to change the wording of the Directive so that it is the keeper (ie in this case the livery yard owner) that has the passport -- and in some cases that the keeper is the one who has to apply for it in the first place :-(. However, DEFRA is working very hard to try to prevent this and it looks as though they might succeed. So don't say they never do anything for us!
 
When my horse goes out on loan I'm initially planning for them to have a photocopy of the passport until I get to know them. When his jabs are due I will let them know (not til Oct) and send/take it down. By then hopefully I will know them well enough to trust them!
 
Wow so glad I read this post, I didn't realise the yard owner was meant to have the passport, although on saying this mine has never asked for it and he is now on full livery too.
 
I think it should be with the loaner. The only reason I can think of that the YO would want the passport is if they had to transport the horse in an emergency, as it is now law that when horses travel they have to have their passport. For that reason the YO were the beastie lives has a photocopy ofhis passport.
 
Yes when you travel the horse the passport should be on board too. So whoever is in charge of the horse should presumably have it?

It is worrying when loaning a horse but the loanee should definitely have the passport or they wouldnt be able to go anywhere.
 
I would be really careful about giving out my passport as it has all the horses details and if someone wanted to sell your horse while on loan or say it is theres you could have real problems...I tend to give out photocopies.
 
I looked into this with DEFRA and trading standards and was told that for full liveries it should stay with the yard owner, for part and DIY the horse owner can hold it but they advised me as teh yard owner to take copy of the passport
 
As the law is at present:
If your horse is on Full Livery then the yard owner must have possesion of the passport. If it is at do-it-yourself then the person that cares for the horse should have it. If It is at grass then the person that cares for the horse should have it. If your horse is travelling to a competition then the passport should be with it. If you loan your horse out then it must be given to the person that is loaning it and they should pass it on where necessar.y If you are concerned that the passport may be lost/stolen or mislaid then I would ask a solicitor to make a certified copy of it for the owner to keep.
The passport legislation is enforced by the fair standards trading office.
If you wish your horse to be identified in the event of theft then have it freezemarked on it's shoulder and also microchipped.
 
In France you must hand over your horse's passport to the yard owner. If you are traveling you have to borrow it back for the journey. This, i believe, is to have all passports available for the authorities should the yard be checked. Typical France - you cant go anywhere without a suitcase full of I.D with you! The DEFRA full livery bit might be relevant - yards in France tend to be full livery only.
