I bought my land twelve months ago and had planning permission for stables, hardstanding, gate widening etc. My 7.5 tonne lorry has been parked there since I moved in. I have just had an Planning Enforcement Officer from the Local Authority contact me regarding the fact that I am parking my 7.5 tonne lorry at the yard. He is saying I may have to have additional Planning Permission? Has anyone come across this regulation pls? I am waiting for the Planning Officer to get back to me but would appreciate any assistance as this seems a bit over the top and no-one locally has heard of this.

It might be.....that it is parked there before you have built your yard? Similar to requiring permission for a mobile home while building a house?

No not had a problem we have planning permission for our stables and have to pay rates but are not allowed to do livery. Others down our lane have just put up stables and pay nothing but unless they get complaints the council don't do anything. I would think someone has complained

If the lorry is 7.5T and not over (and therefore not an HGV which would require specific PP to be there) and it is for private use then the lorry itself would not require PP I dont think, esp since it is moveable and unlike a caravan when doing up a property, it isnt being used for residential which is where they can need specific PP/agreement.

Perhaps the planning department might have wanted you to put a specific bit in the PP about parking space for it but Im not sure you needed to, it is private non HGV vehicle and its presence is clearly relevant to and incidental to the PP already in place for the stables/keeping of your horses.

I wonder what they would have said if it was just a trailer, and someone complained about it being there.... no difference in terms of non HGV equipment/vehicle in planning terms, but I suspect they would have told the complainant to go away then.

I wonder if the planning officer is getting confused with over 7.5T vehicles as this is a 7.5T one?

Edited to add if they do get sticky then useful to play on one main reason we have boxes at yards - the need to get horses to vets/horsepitals in emergencies....:-)

When you got the original PP did you stipulate what the hard standing was required for, ie parking area!! If you mentioned it in the PP they don't really have anywhere to go, if you didn't but the hardstand has planning then the argument would still be in your favor as what else would you do with it. I can only see a problem if you are parking on the paddock rather than the area covered by the original planning application, the planning only applies to the area that is developed not necessarily to the whole plot.
Either way I would be inclined to wait and see if they threaten to put an enforcement order on you, this may be a case of someone complaining and the council being able to say they have spoken to you, it may now just go away with luck.

Thanks so much for all your help everyone - this was my first post on the forum and it is great to be able to share issues and get advice. I do not feel quite so concerned now and will wait to see what develops from Planning. They will probably want me to spray it green or something to match the landscape (unfortunately it is bright red) lol. Not really sure why anyone would have complained as it has been there since the stables went up and the horses went in last December and I am a good 700 yards from the nearest property (which has a 7.5 tonne horse lorry also). I'm wondering who I have upset locally lol:)
