Poor Quality Boots - Rights as a Consumer?

For Xmas my OH bought me a pair of Mark Todd Boots from Discount Equestrian Website - unfortunately they were too tight so were exchanged for the next size up - so I got them in the New Year.

I wore them & found they were too wide to fit in my stirrups so I stuck to my normal boots, and only wore them a dozen or so times in Feb/April. Then a few weeks ago I put them on again, and noticed my heel was bleeding when I took them off, I have examined the boots and the plastic spur support has come loose/worn through the inner lining of the boot rendering them unwearable.

How long should a pair of boots last? I have tried contacting Discount Equestrian several times to no avail and the Company that make Mark Todd products say my contract is with Discount Equestrian!

I am not happy that £80 was spent on a so called reputable brand that only lasted in essence a few wears and feel peed off with E.D and will never use them again.
 
Its a disgrace the DE havent got back to you, thats bad manners. Mark Todd are right in that you need to deal with DE but it wouldnt hurt for them to help out! Problem is, you bought at Xmas and have left them for 8 month before making a complaint (I appreciate you have only just started wearing them, but they arent to know that). Im not sure of the legalities, but you might have to swallow this one.

Might be worth contacting Mark Todd again and saying that you cannot get any answer from DE therefore you have no choice but to contact them, as the boots are not fit for purpose.
 
Will be watching this thread closely! I'm in a similar situation and have only worn the boots a couple of times. However the zip has broken right off..despite them costing £120!!!
 
Had a pair of the winter mark todd boots (the £120 ones) lasted a week of light (I work in an office full time and only do horse once a day) use and they disintergrated!
 
Contacted Mark Todd/DE at the end of April!! followed it up twice and now I'm Royally fed up!!
I have now told them they are obliged to replace under the sale of goods act, which outweighs any warranty they offer! They also have a FB page which I have politely asked them to reply to my emails!
 
Contact trading standards/consumer direct as this is a faulty item & thus is not of satisfactory quality.
They will give you a reference but you have to approach the retailer(send a recorded letter) - templates are available free -in the first instance.
 
Not fit for purpose is the phrase you want. I think most people would expect boots to last 4 months... Write a letter using the words 'not fit for purpose' in the letter if you get no response from DE then go to trading standards ...
 
In the first six months you have a right to refund or replacement if the goods are faulty. You made them aware of it within 6 months they should have replaced or refunded then. Keep at it!!
 
Oh don't worry I will!! Sister-in-law works for huge corporate law firm in London - she is getting one of the senior partners advice to draft a letter - would normally cost £1000's for a meeting but luckily she is PA to several partners!

But they shouldn't just ignore paying customers and hope they go away! Discount Equestrian shame on you! I am coming to get you!!

I had this on my Mark todd boots (brown fur lined) as did several other people I know who bought the same boots on Special offer in Countrywide. I got a refund from them, there must be so many pairs returned as they all seem to have issues.

How unfortunate that the Sale of Goods Act 1979 has been around for over 30 years and manufacturers are still claiming to be unaware of its terms. The Act gives you the right, as a consumer, to seek redress against anyone in the chain of supply that you choose - that could be the supplier, the retailer, the manufacturer, whoever is most convenient for you.

I am sure Mark Todd as a company are aware of this. It is a pretty basic piece of legislation.
 
I today received an email from Westgate EFI Ltd, who make Mark Todd to say they will honour a replacement via Discount Equestrian, and they have also emailed DE, to instruct them to contact me! Have D.E. contacted me? No, have they buggery!!
 
OK so I am going to kill my OH!! He bought me the boots for my B'day, and it turned out he ordered from DE and they were out of stock so after a week of waiting he cancelled the order and went elsewhere!!! So, basically I have been chasing the wrong Company since April for a replacement/refund!!! Grrrr!!! Would have helped had DE let me know a little bit sooner - but my sincere apologies for tarnishing their reputation.

So I have humbly explained the situation to the Company that the boots 'were' purchased from and am waiting to hear if they will still honour the deal that was offered by Mark Todd!!
