Why is the horse world virtuallythe only place where you have no comeback if goods i.e. horse is not as described ? If you have a copy of the ad which says horse is " blah de blah "etc, and proves not to be the case why cant you sue under misrepresentation or something. Or can you, but its a minefield ?
private sellers I mean not dealers, which is also a minefield but you do at least have some legal clout.
 
it depends in what terms you are talking about. If it is behavioural based ie does not buck then you get it home and it bucks then you will struggle to get help legal wise. You have to be able to proove that the animal did this before you had it, ie getting references saying so from pony club/instructors etc.

Horses are living breathing animals with a mind of their own, their behaviour is likely to change from home to home and what we do to them can also effect them so that is why you have little to come back on, it's hard to proove when this behaviour started. If it's medical then you need again to have had it picked up on before you brought the horse such as in previous vet records or vetting.
 
The fact is with horses that different environment, routine, feed etc can completely change a horses behaviour.

Most private horses are "sold as seen" the responsibility then being on the buyer therefore to make sure they put the horse through every scenario they want it to do (ie hack out by itself).
 
Not thinking of going down this route myself, just pondering that so many times it seems to go wrong and often theres a great deal of money involved, seems wrong somehow !
