Public Liability Insurance - what happens in this situation?

Just had an email from a friend who was out cubbing this morning and riding back to trailer. Another horse was being really nappy and as she went to go past it it turned round and double barrelled hers and her horse is hopping lame after being booted in the shoulder. Vet been out - will be back tomorrow hopefully with better idea of prognosis but horse not brilliant.

What happens in this situation? Everyone who hunts has Countryside Alliance membership and within that public liability insurance. Can you claim against the person whose horse kicked you for all your vets fees?

I would think horse would be insured. Not 100% sure though. Even if horse wasn't insured, surely its up to the person whose horse did the booting to pay up?

If the horse is insured then put a claim through and leave insurance company to decide if to persue the kicker!

If not then it's more of a grey area. I'd advise speaking to CA and see what they suggest.

I take it you have approached the hunt member concerned to discuss?

Its not my horse so no!!

Friend on her horse got booted by another horse belonging to another subscriber but being ridden by someone for her. Does that make sense?

They same questions still apply whether your horse or your friends.

Has the kicker actually been spoken to / asked to cover vets's bills?

If no - that is the first stop.
If yes and they refused/not insured, then time to involve friend's insurers or CA if friend is not insured
If yes, and they agreed/are insured - I'd play it by ear, but still be tempted to involve my insurers TBH just in case of longer term complications

ETA - it would probably be worth getting some witness statements from fellow subscribers. Presumably your friend rode her horse into the kicking zone of a horse seen to be playing up? Now if that horse maliciously backed into your friend and there was nothing they could have done to avoid it, I'd want that in writing from independant witnesses.
