Quick passport question

My ned has gone halfway across the country on 3-month loan (initially) to Claire who has her on part livery at a good yard. In advance of the transport, Claire advised me that the yard needed to see her passport, which is fair enough because the passport needed to travel with the horse anyway. However, whilst I remain the horse's owner and retain the "duty of care", should the passport stay with the loaner or the yard or can it come back to me? I only ask because a friend has worried me by advising that anyone who has the passport can change the ownership on it without the owner knowing.

I think the loaner needs it really. What if she wants to go to a show or the vet needs to treat it?

A passport is not proof of ownership anyway, so as long as your loan contract states it as a loan and not a transfer of ownership you should be fine.
 
The passport should be with the keeper of the horse, i.e. the person who is looking after it. Unfortunately because the passport regs are so sh!t you can actually add a new owner or even get a replacement passport very easily, even at the side of a sales ring.
 
As Spaniel said but I would photo copy every page of the passport on which you have written the date you're copying it along with the loaner's name and contact details and that they understand it is a loan and the horse must not be passed on. Long winded I know but at least then you have proof of your intentions if there are any queries later on. If you do it on a piece of card and reuse for each page it makes it easier but don't cover up anything important like numbers, names and dates. Oh, put your name and address as owner on that card too and sign and date it before you copy anything.
As someone said, a passport is not proof of ownership but this does give you some comeback that you are linked with that horse as the owner on the present date.

As new reg now mean that the vets are legally required to see the passport before treating..
 
The Passport must stay with the horse, so you must give it to the person loaning it.
