Any body reading these posts should chip their animals at least if not freezemark as well , this is your only proof dosnt matter how long you have had /loved you need something to identify this animal to you any one stealing a unchipped horse can soon get it repassported and chipped if need to and they will be the legal owners in a court of law it will be very difficult to prove otherwise plase at least cip your horses-do you not think anyone who has the balls to steal your horse dosnt have a chip locator to make sure it hasnt got one , this is organised crime .
This has heppend to me when i was younger, luckily twenty years go i went round to a local suspects lock up garage herd my foal neigh and knocked on his door <i was a teen at the time no fear just wanted my foal back >told him i went to police i got my foal back .
I have had afriend who had a unchipped horse stolen and it was repassported /chipped and police say this is a civil matter ,please dont think this wont be your horse, hes too old/you cant catch her etc, they will take anything for meat and can catch any horse with sedaline .
Please take care

This is quoted online from DEFRA:

Why you need a horse passport
You could be fined up to £5000 if you don’t have an up-to-date horse passport
You are responsible for making sure you have an up-to-date horse passport so your horse can be identified. You could be fined up to £5000 if you don’t have one.

Horse passports are important because they help to:

•make sure horses that have been treated with certain medicines don’t make it into food intended for humans

•prevent the sale of stolen horses – when you buy a horse, its passport proves its identity
If you don’t have a valid horse passport:

•you can’t move your horse
•vets may be restricted in the types of medicines they can give your horse
•you cannot have your horse slaughtered for human consumption

Regarding the new laws on microchipping, this is copied from Horse and Hound on-line:

Please find below a summary of the changes to passport regulations which kick in on 1 July 2009.

From 1 July, every foal must be microchipped by 31 December in the year of its birth or by six months old

Owners of horses over six months old who do not have a passport must apply before 31 December 2009 and the horse must be signed out of the food chain.

Horses for whom duplicate or replacement passports are required must also be marked out of the food chain

Only vets may microchip horses and chips may only be implanted in the neck

Ponies on Dartmoor, Exmoor and the New Forest will not need passports or microchips until they leave the moor, unless they are treated by a vet. Rump stickers and passports will be used when a pony is moved for slaughter

The keeper of a horse is responsible for ensuring it is passported

Only an owner can apply for a passport. Changes of ownership must be made within 30 days

A horse's passport must be carried each time it is transported. An inspector can also require that a passport be produced within three hours at any other time

Vets must check a horse's passport before it is treated with any medicine and record the drug on the passport. If a passport is not available, only drugs suitable for use within the food chain may be used.

Passports must be returned to the PIO within 30 days of a horse's death

Failure to comply with the regulations is punishable by a fine of up to £5,000

Contradicting therselves I think. Bit difficult when the actual owner refuses to give me the passport.
