RSPCA horse being sold?

yes they are.
When you get a horse from the RSPCA they loan it to you for 12 months, at the end of the 12 months the ponys ownership is transferred to you and you can do as you like with it. The RSPCA will refuse to have anything further to do with the horse even if you find yourself in dire straits and want to give it back to them.
 
As said, once the trial period has succesfully been completed, which I remember as being 6 months rather than a year, the horse’s ownership is fully transferred to the ‘adopter’. I have fostered two young ponies from the RSPCA and I got first dibs on giving them a ‘forever’ home, but I would not have had a job for them as adults, so they went on to other forever homes.

I can personally vouch for both the RSPCA member of staff in this video (she is knowledgable and very helpful) and the rescue centre that she works at.
