Sales Commission

I have sold my horse through an agent and paid 10% commission upon the sale along with the monthly sales livery cost. I got the full asking price within two weeks which I am more than happy with. However, if the horse gets returned, does the agent have to refund the commission or has he technically done his job by finding the buyer?

Hmmm - interesting question. I would think the agent should refund the commission on the first sale and then charge you new commission once the horse is sold again.
Otherwise an unscrupulous agent could keep selling horses to unsuitable homes, getting them returned (keeping the sales commission) and then selling them again. Nice little earner! They could earn multiple sales commission on the same horse.

But I have no actual experience, just thinking of the practicalities.

I assume that your sold horse wasn't returned.

For future reference, there is no right of return if the horse was sold through an agent. The right of return only automatically applies if the dealer owns the animal they are selling. An agency sale is effectively the same as a private sale unless the dealer gives other terms like offering an exchange.

If you, the owner, accept a return then unless you have other contract terms, the dealer is entitled to keep the commission for having made the sale.
