Sales Livery - what legal position for the purchaser?

In my horse hunt frenzy I have seen a couple of super looking chaps but they state that the are being 'sold at livery'. Does this work in the same way as if one bought from a dealer. In other words, are warranties and claims made by the selling agent covered by the sale of goods act? One horse looked super but the seller advised that they were an agent and basically said "don't know" to 75% of my basic enquiries!!!
 
I *think* it does NOT work like buying for a dealer so you wouldn't have the same protection. If you really like the horse ask to speak to the owner so you can get answers to your questions (ideally with a witness present). If the owner lies in reply to a direct question then you do have comeback (although you need to ask the question in the first place).
 
if they are acting as the 'agent' than yes they are responsible for telling the truth and sales description act. They are being paid to sell the horse (usually on a commission basis). But ask the right questions, try it properly in all required situations, get it vetted, and be truthful in your abilities and what you require the horse to do.
 
You have the same rights as if the horse was owned by the dealer. They are being paid as an agent to sell it, that makes all the difference.
