Serious advice needed please

We have had some mobile stables made and they were erected in September and we did put down a crushed stone base- the planners were happy with this.

We really have not had a lot of rain to test the roof until the last few weeks, where we have had plenty- we have a leak in the roof panel that is over the 2nd stable and the store room, leaking quite badly.

We have been up the ladder and it would seem that the onduline roof paneling is too short by some 5 inches and doesn't sit underneath the ridge tile.

We contacted the stable company and they were supposed to come out last friday, not seen sight nor sound of them, we tried to call X over the weekend on his mobile went staight to answephone so left a polite message to call us- again nothing.

I sent X a txt again polite sayiny that this coming weekend I have supposedly the electrics and matting people booked in and then the horses and could he please contact us again nothing.

Finally we spoke yesterday and he was going to have a look that afternoon and patch up whilst he orded some deeper ridge tiles, we explained that yes he could "patch " up but its the roof panel that is too short and it needs taking off and another putting on correctly. Anyway yes you've guessed a no show.

We are going to give them another day and see if he comes today, but my patience is running out, I have given notice at my current yard and I know I can stop on as they have space, but its not the point. I want my horses home..

Anyway we are thinking if they don't turn up this time , we are going to have to get another company to put right the mistake, pay them obviously and pursue the original stable comapny through the small claims to get our money back .

I will email them and also put in writing that unless the roof is fixed to our satisfaction in x number of days this is the course of action that will be taken.

What do you think, would I stand a chance of getting my money back in court, or do I just get it repaired and learn from this experience.

You definitely have a case as they are not fit for purpose. I would phone your local trading standards who should be able to advise you.
 
You could try ringing Trading Standards and see what they have to say. Or are you a BHS Gold Member? They will give you advice on where you stand legally on getting some recompense or actually getting the work done

Not too sure how it works to be honest but personally I would ring either of the above.

If you decide you want to pursue this against the origical company there are a couple of things you need to do:

- write to the original company, stating what problems you are having and giving them 7 working days to reply to you. Send recorded delivery.
- get two other companies to come, inspect the work and quote you for fixing it. They should put down in writing what is wrong with the stables as they are.
- take photographs of problems.

If the original company does not respond to your letter then get the problem fixed.

It takes longer this way but if you go to court and you can't show that you gave the original company a fair chance to fix the problem (I know they have let you down more than once, but written letters are better proof), and that you got competitive quotes for fixing the problems you might not get anywhere.
 
Thank you for your advice everyone, yes good point about taking photo's.

I just wished that they would talk to us , everyone makes mistakes, its how they are corrected that makes all the difference, I guess its what makes a good company.

We went to a local firm as we thought it would be easier to get them back should a problem occur, how wrong could we be.

It states on their website that customer satisfaction is paramount to them - erm I don't think so.
