I really need some help.
Someone has agreed to share my pony with me but I need a few questions before hand.
1) who would pay if he was to injure himself while they would be riding?
2) would you expect them to pay if they were to damage your tack?
3) would you expect them to have rider insurance?
4) would you expect a contract if you were the person sharing the pony? if so what should be stated in the contract?

Having been a sharer, I shall try and help :)

1) Yes I would pay, up until a point. If the horse was found to be unrideable for more than two months or so, I'd probably call it a day. Though it really depends on injury and if it would stop me riding like I had before. (Would it still be able to jump? etc)

2) If I damaged the tack, sure i'd pay for it. If you damaged it, nope. If the horse damaged it..might pay towards it but wouldn't pay for the entire thing.

3) I have been expected to have rider insurance :)

4) I've usually done it without a contract, but it's best to have one. Stating such things as what happens if either of you want out of the contract (notice period that needs to be given), who pays for what, what days each of you do, etc)

Having been on both sides of the "sharing table" I would answer your questions as follows:

1) If the horse injured themselves whilst the sharer was riding - the insurance should cover that, and if the injury was an accident then as the owner I would pay the excess. If you are asking, should the sharer continue to pay whilst the horse is off sick, then as the owner I would expect them to pay up to the terms of the contract - however if they had been a good sharer for sometime and I knew they would continue sharing when the horse was back into work I probably would be flexible. (As a sharer I would be happy to continue to pay for a limited period of time)

2) If the sharer damaged tack - it would depend on the damage. When I was a sharer I was tacking up the horse and as I was putting on its bridle a dog spooked it and it reared, pulled away and galloped off - with the bridle half off. The horse was fine - the bridle not so. I went to the local tack shop and replaced the broken cheek pieces and reins. I then told the owner who said "You didn't need to do that....." If however the tack broke because it was old and not fit for purpose then I would expect the owner to replace.
3) They definitely need rider and 3rd party liability insurance
4) You do need to make sure you have some sort of contract in place.

Having been a sharer in the past and now having a sharer for my horse, these are my answers:

1) and 3) are combined as I would expect them to have rider insurance and certainly when I had rider insurance it also covered accident/injury to the horse when I was riding it as well as 3rd party liability.

2) If they damaged the tack then yes I would expect them to pay to replace it. However, if it broke because of something my horse did and wasn't their fault then I would pay for it.

4) I don't have a contract for my sharer and I only ever had 1 conctract when I was the sharer. Never had a problem either way.

1&2 - the horse and tack should be insured so apart from the excess which you could go halves on then most things should be covered by the insurance. If you want to half the insurance costs then you need to include that in your sharer fees. Just make sure your horse and tack are covered for other people using them.

3 - yes I would expect the rider to have insurance however check your policy to see if riders are covered under the horses policy?

4 - yes a contract should be drawn up, even if it just states the amount you agree for payment, when its paid, where the horse is kept, where the tack is kept, the days agreed and what that person is allowed to do with that pony.
 
I'd always have a contract. I've got a contract template that we used when I shared a friends horse. If you want it PM me your email address and I'll email it to you :)
