I think for me it's that Shires are doing products that are usually already widely 'copied' and they're unlikely to put companies out of business as their intended market is different to the more expensive brands. I.e. people who are paying hundreds for hats or boots will want it for the brand/ logo or some other expensive USP that Shires wouldn't fulfil.
LM copied an idea from a small company with the intent to steal their market and then threatened them.
Maybe I am being unfair or simplistic but to me Shires is ok and LM is not.
