Stud terms & refunds

I paid a stud fee for a stallion to cover my mare by AI. Being completely stupid I didn't insist on written terms but accepted verbal info - I understood no foal/no fee, but was then asked for money before semen was dispatched to me. Having got the mare ready I paid the money. Collection fee also added at last minute, never mentioned before.
Needless to say she didn't catch - the first lot of semen was quite poor but the second lot was OK & she ovulated perfectly to schedule.
That was late last season (she had picked up an injury hence late planning). This spring, before trying again, decided to do biopsy & lab report suggested low chance of her holding (15 yr old maiden). Kept stallion owner informed throughout.
Once lab report known wrote to stallion owner explaining that I didn't feel it was appropriate to waste her time & put my mare through AI cycling again, so asked if partial refund was possible.
After no response to letters/emails, eventually got reply simply saying "no foal free return - so no refund will be given".
I feel stupid for not clarifying things in advance. Any suggestions, other than getting another mare & AIing her instead. It was this special mare I wanted to have foal from so not really a plan I want to follow. There are enough foals being born for no good reason- would rather put it down to experience than breed for the sake of the principle of "getting my money's worth"!
 
No foal/no fee means just that but it is not unreasonable to charge a fee for the collection,storage and transport of semen.How much did you pay?They may not accept a substitute mare either.
 
If all else fails, have you considered chemical curettage for the mare? That could increase her chances for getting and staying pregnant dramatically, and you could then take advantage of the free return?
