tacho in 12T lorry?

Am I right in thinking that while I need to use the tachograph, the drivers hours don't apply because I'm not driving commercially?

The lorry won't be ready until next March if that makes a difference - thought I'd heard something about the rules changing shortly.

Working time directive hours will apply regardless, it can get complicated if you also have a job as well as driving your lorry for your own use.

Goods vehicles Authorised Mass (plated weight) exceeding 3.5 tonnes are subject to the EU drivers hours rules and a Tachograph has to be fitted and used.

Where the MAM of the vehicle does not exceed 7.5 tonnes and goods (horses in our case) are not carried 'commercially,' then the EU hours do not apply and the Tachograph can be ignored.

If the vehicle is more than 25 years old and goods are not carried commercially the EU rules do not apply and the Tachograph may be ignored. There is no weight limit to this exemption.

If the box was first registered on or after 01/05/2006 the vehicle will be fitted with a digital Tachograph. You (and anybody else who is going to drive the vehicle) will need a Driver Card and you will also need a Company card. You will need to and store data from both Driver Cards (monthly) and the Vehicle Unit (posh new name for the Tachograph) every other month. The process sounds complicated but in reality is quite simple once you've done it a couple of times. You just have to remember to do it!! The cards cost £37 for the first issue and then £19 when renewed at 5 yearly intervals. The downloading tool costs around £150 but see it you could borrow one from a friendly local haulier.

cheers - I've sent away for the forms to get my tacho card and my local DAF garage has said they'll download the data for us. :smile3:
I just wasn't sure wether the drivers hours applied to us.

I can't wait to get the new horsebox :biggrin3:

A fixed week for EU regs is sunday midnight to sunday midnight

If you drive a LGV over 7.5 tonnes GVW for any time during a fixed week then another job done must legally be recorded officially - the easiest way to do that is to use a separate analogue card for each day with your name date start and finish time on each - after 29 days those cards can be binned

This is so authorities can see what daily and weekly rests have been taken

Generally this means that if you have a mon to fri job you can drive for one day every other weekend

^ yeah that - glad someone can explain it in English ;-). Lol - I would be scuppered along with my OH who is an lgv driver due to working hours etc during the week - the whole EU thing sucks to be fair ..............

we would still have to drive within the time limits though and take appropriate breaks.

the working bit is confusing me - I always thought the working hours referred to commercial drivers only?

ETA: had another look at the dvla/vosa link - obviously didn't read it properly the first time.

Private or commercial the rules are the same if the box is over 7.5 GVW

No doubt it will change again in the next 12 months as the introduction of CPC has now left a shed load of part time drivers without a job, bet the government didn't foresee that one landing on their laps :eek:(

This is what confused me, is this not showing your WT through the week, only in the form of a tacho?

The normal WTD can be opted out of
The RTD is for mobile workers like those under EU regs
The WTD and RTD do not get added together as there is no requirement to in law to do so

Just an aside. I have a 7.5 ton (just bought it) and been advised to use the tacho with a fresh chart each day I drive. But where do I buy the blank charts from? I'm not going to need hundreds of them.

This was after nearly being sideswiped by a tractor after pulling over and being stationary, to allow him past. My instructor (booked to give me a lesson first time out in 7.5 truck) was shocked by how close the tractor came, and said if he'd hit me, I could have proved I wasn't moving at the time.

No harm in using the tacho if you wish to but mark every chart as - out of scope - that means it is not being used under EU regs

I get mine from www.tachodisc.co.uk I pick mine up from them when passing but they also post out, they are only £3.73 per box, I think there's 100 in the box, I buy them in bulk as we go through dozens and dozens per week...

Cheaper still at Tachodisc... and super fast service too :)
