Or at least can string a sentance together, I'm trying to modify a loan agreement and know what I want to say but can't put in nicely if you know what I mean.

Basically, I'm trying to say that if they jump the pony must be warmed up for a minimum time first (I know you would expect this but just in case!) I don't want him jumped higher than say 2ft, and how do I say that if they can't come down then they have to pay the additional livery costs?

Please help if you can?

For example:

Section 10 - Conditions of loan

10.1 - Dobbin must be gently exercised for a minimum of 15 minutes, as a warm up, before crossing any obstacles of any height. This may include trotting polls, jump poles, cross-country fences, this list is nonexhaustive.

10.2 - When Dobbin is to be excersices, any obstacles intended to be jumped MUST BE 2 feet or below as an absolute maximum.

10.3 - Any additional charges incurred will be payable be the persons Dobbin is loaned to, named in Section 1 above. These may include, but not limited too, any additional livery charges, fees or costs.
 
I think you'd find those clauses quite hard to enforce tbh.

What happens if the pony is aimed at a 2 ft fence but clears it at 3ft or are you saying it must only be aimed at a trotting pole and hopefully it'll stay within 2ft. Whose to know and whose fault if pony jumps higher than specified and does itself an injury.

Only trying to play devils advocate but quite a strange set of rules IMO.
If you want pony to stay within 2ft due to an old injury i'd personally forget about jumping and state pony is to loaned for flatwork / hacking only.

As for if loaner can't get to yard just state' loaner must pay for any additional expenses incurred for livery cover if loaner cannot attend yard or something similar.

The livery bit:

Under any circumstances whereby the loaner does not or can not attend to the pony's need on any day that they have responsibility to do so, all livery costs incured will be charged to the loaner.

OR

If the situation arrises where the loaner cannot attend to the pony's needs on any day they have responsibility to do so, the owner (insert name here) must be contacted by (11am) to organise alternative care on that day. Alternative care will be in the form of livery. Any livery charges incured on a day where the loaner has responsibilty must be paid in full by the loaner before (5 working days) pass.


The jumping bit:

In the event that the loaner wishes to jump, the pony must first be warmed up for a minimum of (10) minutes to include walk, trot and canter on both reins before jumping a maximum height of 2ft. A jumping session, including warm up, must be no longer than (45) minutes.

Or something. I dont know! Im doing gcse english so thought id have a crack at it! haha
 
Thanks both of you, The only reason I want to put a maximum height on the jumping is that although I trust the girl who is going to be loaning the pony its the first time I have done it so am trying to be careful in the first instance. I have seen some of the teenagers on the yard ragging the hell out of their loan ponies and am just trying to avoid an awkward scene.
 
TBH, I don't think whatever you right in the loan agreement will make a difference, it will all depend on the loaner and you'll have to make a personal judgment I'm afraid.
 
I think you are being sensible. Although hard to enforce to the letter, a contract setting out very clearly what you expect of a loan home will hopefully mean that awkward situations can be avoided further down the line.

When I loaned my mare before buying her, there was a line in the loan contract about how I should look after her as though she were my own, with all the responsibilities thereof. I always thought this was a good 'overall' clause to put in a loan contract.
 
Thanks, Its just worst case scenerio really, I want to be able to go up and say, hey we agreed blah blah if I see something I don't like, where as if I hadn't put it in I couldn't.
