I cannot find anything that says its illegal however that is a good safety point which should be seriously considered

Yes it can

It cannot be downrated to lower than its kerbweight + driver but if you did it that low you could not put anything in it except the driver !!

What is the unladen/empty weight of the lorry?

If its 5500 UL or more they wont down plate for it to carry less than 2000kg ....
