Trying to cancel saddle order

I placed an order on a saddle after having a fitting and the saddler took a 50% deposit, I contacted the saddle within 14 days and advised that I was not longer sure about the saddle and would like to cancel the order.

They came back advising that deposit on saddles are non refundable.....

The saddle is a good seller as they didnt have any instock when I wanted one and has not been altered in anyway.

How do I stand, I dont want to cause a big fuss but dont want the saddle or the hassle of trying to sell it on as brand new due to the loss of money.
 
Telephone your Trading Standards office, at the local council and ask them about the law and deposits. In a way I suppose it depends on what is said on the saddle suppliers terms and conditions, although a 50% non returnable deposit sounds rather excessive, if it is not a made to measure saddle.
 
I have no idea of the saddlers t&c's aas they have given me nothing so far .....

Will try trading standards tomorrow and see what they say.
 
Deposits are normally non-refundable, unless there is a problem from the sellers side. 50% is a lot, but I think it would be in order to retain up to 20%
 
contact BETA. sounds excessive to me for an off the peg saddle. did the saddler come to you? (thats under the distant selling policy/act) did you sign anything? did you read before you signed?
 
If they didn't state that the deposit was non-refundable then they can't impose a term now. 50% would not be considered reasonable, unless they were having to get special leathers, etc. in especially for it.

Interested to know, I refund people back their money on saddlery that is off the peg, anything custom made is not refundable as it is specially made to fit andthis is always stated that at time of ordering, Oz :)

Have spoken to comsumer advise, they have advised is comes under the canx of consumers contracts within the home or work places (as it was at the horse yard) Reg 2008.

Saddle fitter should have given written info that the cooling off period is 7 days(not working) if they failed to give info its unenforcable and can canx whenever. . The cooling off period could then start from when the info was given, if it was given at a later date.

Ive requested reciepts and fitting details but they have failed to arrive, I sent an email yesterday requesting my funds back minus call out/petrol but still no reply.
