Hello all!
There is an performance horse at our barn who has recently had to be retired after a veterinarian's mistake during a surgery which damaged a ligament not at all associated with the initial issue, and we are looking into a veterinary malpractice suit with the hopes of settling outside of court. The damages caused by the surgery required an additional surgery to correct the mistake, and the injury caused by the vet has failed to heal even after those corrective surgeries and long periods of rehabilitation. We have clear diagnostic evidence of the mistake made. The owner initially went the insurance route, but insurance stopped covering anything related to the injury after the first surgery that caused the damage. Located in Virginia.
I have been scouring the internet for relevant information on this topic, but it's been nearly impossible to find any information beyond "this is nearly impossible and not worth it--just don't do it." I would love to hear more about complications that may arise when pursuing this, but it would be so helpful to know what this would look like logistically to pursue, complications and all. If anyone has links to other resources, relevant experience, recommended lawyers to consult or any other helpful information, please let me know!
