What rights so I have?

Here goes for the long story. I live in a house with my own yard, I buy and sell showjumpers. I have a 18year old son and a 9year old daughter. I got pushed into marriage and my husband worked away alot. I have a yard full of horses who are lame or showjumping ponies aswell as my husbands 3horses.

I left my husband after along time, I was fed up of being treated like a total mug. I was never allowed to have any fun, my job was to look after the kids and that was it. After 16years of an abusive marriage I finally left him after he hit my daughter.

Hes now buggered off to a different country telling my daughter by text the morning before and stating he wants nothing to do with any of us anymore.

I have just sold my house and am moving to a new house with stables. But I do not need as many as I am not dealing in horses anymore. I have room for my horses/ponies but I have been left with husbands 3horses. 2 are showjumpers but are left in the field and the other is a brilliant RC horse. I cannot afford to keep these nor do I have the room, hes changed his number, I do not know where he is anymore.
I need the horses to go but in my own rights what can I do with them I would love to keep them as they have been with us for 7years but I simply cant afford it and I have now been dumped with them.

What rights if any do I have over these horses? They are in his name the passports and the papers of them etc.
 
Hmm thats a difficult one. I think you should ask a solicitor personally. It could be that as he hasnt paid you any livery money for their keep, you have no way of contacting him etc you can sell them to pay what he would owe you and then IF he ever gets back in touch you give him the rest of the money.

If it was me I would just re-passport them and sell them and stuff him but then Ive gotton to be a hard biatch thanks to my ex!!!!

Seek prof. advice and let us know how you get on.
 
I agree that you need professional advise, I think that you will find that if he has been gone for over a year, has had no contact with you or the horses, paid no livery etc then technically it is classed as abandonment and legally they are yours. But I do not know the full facts on this so you will have to get it checked out to be sure. OR you can work out how much 'livery' he owes you and sell the horses to cover what he owes you. There are a lot of people on here a lot more qualified to answer your question than me though. I hope you get the answer you are looking for. Good Luck
 
Thats a hard one, I think you need legal advice, try CAB. I believe that if you can prove that you have been responsible for thema nd their cost upto their value you'll find that you have a case for them to become yours or you might be able to prove they have been abandoned into your care or something...
Couldn't you just send the passports in and get them transferred into your name, (it ridiculous but I didn't even need to send proof of purcahse to get the passport put in my name for my last purchase), then sell them? If he should ever get in contact with you again and they come up you can take off the costs of keeping them off what you got for them and give him the difference.
 
Just had an idea...if you don't need the money from the sale of the horses, couldn't you loan them out, then if he ever returns for them you could still get them back...just a thought!
 
first let me say well done for finding the balls to get out off the relationship.i agree you could put them on loan.have you got a divorse ,how were things split if you did who has the horses if not then surly you can just sell them as whats his is yours i would.some would call it revenge but i would call it pay back. have women not sold there husbands sports cars on ebay

Sell the horses - he has abandoned them - and deposit the money you get for them in to an account for him. If he doesn't get in touch within a certain period of time, give the money to the kids.

Presumably you've notified him of you intention to sell, so there shouldn't be any problem.
 
Firstly - well done for having the courage to get rid of a waste of space. Having been there and done that, it will be the best thing you ever did! With regards to the horses - how was the house sale split? Are you divorced yet or in the process of getting one? TBH, as you can't get in touch with him and he owes you livery & expenses for the horses - I would simply sell them.
 
CAB will give you free advice so it could well be worth talking to them in the first instance.

I would think he's abandoned them or you've earnt their value in livery over the years so you have every right to treat them as yours and do what you want.

Also do you belong to BHS/BD/BSJA/BE ? If so they all have legal advice helplines that are free and specialise in "horsey" things so could be worth ringing and asking them?

Take it you are not divorced yet as surley ownership of the horses would have come up in that?

) that regardless of the horses he has a 9 year old daughter to provide for. I presume he isnt paying CSA or anything as you cant find him? I would def speak to a solicitor as you need to get this sorted also. Maybe selling the horses goes towards the contribution for your daughters upkeep. Like i said i am sorry if i am repeating something you have already done but he cant expect to just get up and leave and not be made accountable for his family left behind. Well done girl for getting out of that relationship and protecting your kids. I would suggest if he has been off the scene for that long then he has 'abandoned' them. Also as you have clearly made 'reasonable steps to locate the owner' and havent been successful then you may well be entitled to sell them to recover the costs for keep etc. Is there a family member of his that you could write to asking them to pass the letter onto him saying you are giving him a month to make contact otherwise they will all be sold? Lastly, would they not be a marital assett (sp), in which case you are entitled to half their value anyway. Take legal advise as first consultation is usually free. Good luck.
 
I echo the advice about getting a legal opinion. Is there a way to txt or email your ex asking for a letter of permission to sell from him? If he does not get back to you I would contact a local humane society (ILPH do you call it? ) and put in a statement that the animals have been abandoned by him.

There must be some sort of neglect law that deems him no rights after abandonment thus giving you the right to sell them.
