hiya about 7 months ago i sold my throughbred... well on full loan the bloke lives about 300 miles away he was kind of messing us around but then he said he would come and pick her up he signed a contract saying that he would pay the money now he barley has his phone on and if he does he would barley will answer.. he still ows us quite a bit of money i am so worried about magic now and i dont know whether we can really trust him its not like we can just go and pick her up as he is so far away he has paid some of the money but nothing to what he ows us i just dont know what to do now... we have tried asking for the address of where she is so we can go up there but he wont give it to us and he wont send a picture ... what would you do?

He has your horse, has promised to pay, won't answer the phone and owes you money and won't tell you where the horse is? And i assume this was a trial with a view to buy with some kind of timescale.

I would be calling the Police and reporting the horse stolen.

Is the horse identifiable and what area is it (probably) in now?

do you have a photo of the horse?

When you call them you have to be completely clear that there was a promise to pay, ad that the man is not answering any contact and that you have some evidence of current ownership - it is either theft or fraud by false representation, depending on the circumstances

Firstly, what a pretty mare!

I had a situation where one of my horses was on loan. The lady didn't owe me money, but kept putting me off when I wanted to visit and hardly ever answered my texts, mails and calls. My horse was a long way away too. I had arranged with a lady from this forum to go and see him as she lived very close, but luckily I managed to get hold of the loanee and got my horse back.

If you can get a location I would go and get the horse, just arrange a transporter or take a trailer. Have someone up in that area keeping watch. This is your horse and isn't paid for by this man so just go and get her back before it's too late.

Hope all goes well and keep us informed.

You could also send him a recorded delivery letter saying your going to report the horse stolen unless he pays you or sends Magic back.

Must admit though I would just go and get her. Remember not to cause any damage though as he could prosecute you.

yeah we really want to go and pick her up but he wont give us the address of the yard... the first idea was what we were going to do! she is still registered in our name so that should still be alrite but cuz it has been 7months can we still do that?

Sounds very dodgy ,face it he may well have sold her on .No way would I let a horse go to a stranger without full payment .If she was just going as a companion then surely she was not worth much at all.
I would name and shame on here and see if anyone knows him .If they don't you have little chance of ever sorting this out .
I feel sorry for the lovely horse and hope she is ok.
Sorry to be blunt but to let a horse go like that is madness.

I would contact the police with any paperwork that you have ,sale agreement/loan passport ect .Try putting a notice in newspapers local to the area you believe the horse is.Contact vets in that area ,blacksmiths ect . If the police wont help you could try the small claims court .When you find the horse if you go to get her video what you are doing so that he cant claim you used force or did any criminal damage -good luck keep us informed

oh great thanks its so worrying though we managed to get hold of him yesterday! he said he is going to send some money down to us! whether he does though cuz he has said this so many times now! if he doesnt send it down this time we will definetley do something and i will definetley keep you informed and thankyou to everyone

Magic is lovely! If you have his address you could ask someone in that area from H&H forum to go and see if she's still there or ring police if you have proof he still owes you money.

i know for us it seemed really like it was going to work out... we are MENT to be getting the money and a photo of her some time this week his excuse for not phoning us back is that he never has any credit... and i said that dont you have a home phone and he said no! like i said b4 we are going to wait till the end of this week and if we havent recieved anything from him then we are going to do something so i will let you all know! thanks again

I just hope she's being well looked after wherever she is. I can't believe people actually let complete strangers take anything from them without payment at the very least - especially if the thing in question is a living animal.

Personally I cant believe you were so stupid, who in their right minds thinks a companion horse worth nothing, going to a dodgy old bloke from miles away is going to have a good life. You are the sort of person who gives the likes of Jaime Grey a living.
