I have posted previously about an accident my horse had at our livery yard on the wire fence which was surrounding our newly given paddocks i am mostly to blame as i turned my horse out knowing wire was dangerous i did however put white tape around the inside of the rails to give them more visibility of it but if i wanted her to go out it was this or nothing, the wire was not as taught as it should of been due to it not being repaired properly after a previous incident which i had reported to the very blar-say yard manager well to keep things amicable i called the YO and asked if she would be prepared to put any thing towards the vets bill as i thought they were partly to blame as they should know how dangerous this type of fencing is for horses and they hadnt maintained it to a high standard......... but the YO told me basicly that she would not take any responcibility and NO she would not be putting anything towards it!!!!!!!

Hi. I would seriously consider moving yards. Not always an option I know, but the YO has a responsibility towards the liveries and this is pretty bad practice, which in turn leads to bad feeling and that is never a good thing for anyone.

At the end of the day your horse deserves a safe place to be. Another altervative is to consider placing electric fencing along the fenceline to keep them away from the wire??

hi thanks yeah i am leaving yard already thank goodness, the YO has replaced all the fencing of the new paddocks now it,s just sad that it has taken my horse to have an horrific injury for her to see how dangerous it is.......and that she hasnt replaced every ones fencing ther is still many paddocks with hanging wire and even barbed or sheep wire i just feel these kind of people dont deserve to have a buisness wen they charge such alot for a very poor service but no 1 will speak up it is a total sham ......

If you have nothing to lose how about taking out a claim in the small claims court? Have you a contract from your YO. Even without it you could still have a claim - there is a duty of care that livery owners need to abide by. Why not hit them where it hurts - after all your horse has sustained an horrific injury and you have had what sounds like quite a bit of stress from this situation.

If you can't get mad get even!!

You could also consider the mediation bit which would not be quite so official but you could still get your point across and some compensation.

But because you asked YO to fix and they said no, then accident happend, then they fixed the fence, they technically have allready admitted liability for the accident.. (hope that makes sence) because they fixed it, it was therefore broken.

I would persue this if i were you, afterall they have a duty of care...

Pictures of the fence before an after would be nice if you had them help you build a case

thankyou i have got some pic,s of fence befour and iv also got a statement from the two girls that found her but i had to weight with equita for vet and as soon as the YO heard wot had happened they rushed off to fix fencing .....buggers.....
