Where do i stand - copyright issues

My old website was made by an IT company, and since, his communication has become appauling so i made my own. He came to do some pictures for the website and so still has them on his computer etc...

A friend hs just sent me a link of a website .. http://www.cornerhousevets.com/contact_us.html and the picture down the side is one that he took of me and my horse. He has used this photo without my permission, and im not happy for him to use it, so where do i stand. It wouldnt bother me usually, but when i told him id made my own website due to communication issues, he got rather 'bitchy'

so just want to know where i stand before i approach him about it.

He took the photo, he owns the Copyright. He is entitled to use it as and where he wishes, unless you are a minor.
