where do i stand? saddle does not fit

I recently bought a cob for my other half. The seller had a leather saddle which we bought seperately. The cob was very fat and so I thought that as she lost weight the saddle would fit better. She is fit and trimmer and it is obvious the saddle does not fit. Have contacted the lady we bougt off. She bought the saddle 6 months ago from a large tack shop locally. They came out and fitted it although when I look on their website and the mastersaddlers website they are not trained to do so. A mastersaddler fitter has seen it and confirmed my suspisions that it does not fit and not suitable etc. Do we have any leg to stand on in complaining to the original tack shop?
 
My thoughts would be no as the original purchaser took delivery and had no complaint .The tack shop had no agreement with you - perhaps ask them if they would consider px for something more suitable .
 
If the saddle is only 6 months old, can you get the original receipt from the owner? It should still have some warranty under normal consumer protection...
 
I would look to sell the saddle or part exchange it. If the original owner was happy with the saddle, used it etc, (even if it was, in your opinion, not right, she accepted it as being fine) and the horse has now changed shape, I am not sure you have any grounds for complaint.
 
The horse can change shape a lot in 6 months, I don't see how you can prove that it didn't fit when it was originally purchased. I wouldn't have brought it from the lady who sold you the horse, as it didn't fit at that time.
 
Sounds like a good idea to ask for a part exchange. If they are good at customer service & care for their reputation they might be willing to give you a good deal, even if you did not make the purchase. But again who knows how well it fitted 6 months ago.
 
you do not have to be a master saddler to fit a saddle. I've also seen some bad fits done by master saddlers that have caused problems.

You have no grounds to take it back as you didn't buy it from the shop.

You also cannot prove that it didn't fit 6 months ago when it was originally fitted, You've admitted the horse has lost weight, is fitter and changed shape.

Even if it had been fitted by a master saddler and you had bought it direct, you wouldn't be able to do anything. I've been there, called the society and asked, and was told tough!
 
I recently got a new boyfriend. His previous girlfriend had bought him a pair of jeans 6 months ago that fitted him really well. Because their relationship was going down hill my boyfriend drank alot and has put on about a stone. Despite him helping me muck out and losing some weight, the jeans still dont fit. Do you think i could take the jeans back to the shop and get a refund?

No. You yourelf have said the horse has lost weight, so have no proof the saddle did not fit when fitted. Also, you did not buy from the shop so their contract has ended.
