Where do I stand???

Hi- if anyone can offer me some advice here I would be very gratefull.

I sold my horse a week and a half ago but 3 days after delivering him the woman said she wanted me to take him back as he did not get on with her other horses. I agreed I would have him back and we made arrangements for me to pick him up on Saturday. On Friday night I got a phone call from her friend to say that she now did not want to give him back. In the mean time I have put a deposit down on a field to rent (£200) this money is non- refundable as I have already spoke the yard owner.

So my question is where do I stand with getting my horse back I do have all the text messages and emails she sent me confirming that he was coming back.

Any advice.............

Im not looking to buy another horse- so no use for the field.

It will cost more to buy him back but to be honest I'm not worried about that as Im just worried that she will now sell him on for more than what she paid for him and he does not deserve that.

Ring her, ask her why she wants to return a horse after giving it 3 days to settle! Of course he doesn't get on with them yet, what did she expect?
I see no reason why you should take him back, tbh. Ask her to give him more time to settle and if otherwise he's fit for purpose. If the answer to the latter is yes, don't take him back.

Well, manners would dictate that she pays you that, or at least something towards it - to cover the inconvenience caused, sadly most people don't have manners so I'm afraid you might have to chalk it up to experience on this one.

Hang on - are you saying you want him back? People can say what they want - as no money changed hands I dont think you have a leg to stand on if you do want him back.

i agree with this - but reckon getting your money back will be difficult..
also im not sure they have to give him back - even though they said they no longer wanted him as they have paid for him and he is now their "property" as such.

I agree they have no obligation to give the horse back. I could tell Vicki I'm going to give her my pen, but unless I want to...she can't make me give it to her.

My view is that the new owner has paid for the horse and it is her property now. It is annoying to say the least, that she has changed her mind about sending him back but unfortunately you cannot insist on it.
Also, sadly, you have lost that deposit on the field, unless you can persuade the field owner to perhaps even give you half back maybe?
My only concern is that the new owner won't suddenly change her mind again and ask you to take him back for some other reason. I'm not sure what the legalities are on that side of things.
I really feel for you,it is a difficult situation and no-one can afford to lose money in this economic climate.

I would speak to the person you sold the horse to, rather than the friend first off. And if she definately doesn't want to send him back ask them for some recompense towards what you have spent making arrangements for the horse.

Lol yeah i was a bit confused!

Op i think you just have to lose your deposit money - its the cheapest option for you - and even if you are worried about the horse, well, you sold him and he is now theirs to do as they wish with.

(oh and Kitsune - if it isnt a Parker im not interested anyway!
