Who is liable for costs

if a horse has been out on loan but the loanee no longer wants the horse, who pays to send the horse home?
I am being told today that I have to pay for my horse to come home because the loanee no longer wants him. She says that as she paid for transport there it is my responsibility to pay for him to come home, but as she has broken our agreement and wishes to send him back without a months notice I might add.
I pointed out she got a free horse and tack and rugs........some people would give their high teeth for that.
What do you think????
 
If she complies with the stuff that is in the agreement eg the months notice, but the agreement doesnt state about the return costs, then its arguable maybe you should pay. But if the agreement has been broken as here ie no months notice, then I woudl say if agreement is silent then she should cover the costs. Or you will and she gives you the months loan fee.
 
Don't see there is much you can do ,I presume she has had your horse on free loan .Ask her to meet you halfway on cost,I would just want my horse back quickly ,I bet she has not had it shod or wormed lately and may owe money for livery.
 
For the sake of the horse, I would simply pay. Unless you have 'penalties' in the agreement if the loan arrangement should be broken, there is not really much you can do.
When I have put ponies out on loan I have always delivered and picked up myself for my own sanity.
