Sorry for the possibly stupid question, but I genuinely haven't a clue, or even any knowledge of stud policies. I was just wondering, if you wanted a foal, or a couple of foals, and knew when you wanted it/ them, could you get a stud with a mare whose breeding you liked to get her in foal by a stallion of your selection, with the foal's ownership all paid up in advance?

Yes I’m sure that would be possible. In fact I have a friend who essentially leased a broodmare that stayed at the owners stud.

If I had a mare and were doing that, I’d expect you to pay the stud and vet fees upfront and accept the risks involved in that, I wouldn’t want to end up with a foal not of my sire choosing if the buyer backed out.

You would be leasing the brood mare so all the costs (and risks) are yours.

But, yes it happens.
Particularly for rare breeds if someone particularly wants a foal. I don't know what sort of money changes hands, I suspect it varies between not very much to quite a lot.

But most people wait to buy a foal when it is up on four feet and ready to be weaned.

It seems perfectly logical to me. You like a mare which the owner wants to put in foal, you suggest a stallion. If mare owner likes said stallion too then they will go ahead with having her covered. Sale guaranteed? What's not to like?
My concerns:
Price: needs agreeing up front, perhaps with stage payments.
Sex of foal: do you have a preference?
Foal has some deformity: will you still buy?
What involvement do you want before foal is collected? 18 months is a long while to wait without regular contact.
Brainstorm what can go wrong, then have a contract drawn up and signed by both of you. Hope it goes well.

I know a small stud which does this. You need to pay quite a lot up front for stud fee and keep of mare until the foal is weaned. I don't know what happens if you don't like the foal or for some reason you don't end up with a live foal.
