Yard Owners rights of access advice please

My friend rents a yard off somebody who herself rents off the local council. My friend gave notice to leave two days ago and today the YO is going onto the land with new tenants to do some work. We aren't sure if this is with a tractor or not but my friend hasn't been informed (she heard this from the new tenant who just happened to mention it last night). Surely she has a right to be there and calm her horses when big machinery is going in? Can anyone tell me if she can say no and arrange another date/time when both her horses and her liveries horses can be moved to a safe place? I will also point out that the work that needs doing is something my friend has agreed to do herself but obviously the YO hasn't given her any time at all considering the notice is 4 weeks. Thank you.
 
I should imagine that provided sensible precautions are taken to ensure that the horse stays safe then the YO can access the facilities as he or she likes.
 
Why can't your friend use electric fencing to pen her horses while this work is going on? IME horses are not unduly worried about big machinery. We have had a half mile road built and a barn conversion done whilst the horses were out in the paddocks and very close to the works.

YO has right of access whenever she wants.
 
i would have thought 24 hours notice to access the premises, or if its emergency work then they can go in without your permission. However with horses i would have thought they would need the horses moved to safety first hence the need to give you notice. i could be completely wrong tho, but thats what we used when our yard was rented to us.
 
Thank you both. She doesn't have any elec fencing and neithe do I so I cant lend it to her. I dont know what she will do then. Previously the yard owner has taken a whole barn away without my friend being informed. Seems very unfair to me
 
I'm assuming your friend has phoned the YO to discuss their concerns.

Usually, by far the easiest way of resolving things.....
 
Re the electric fencing: if you do not have stables then you should always have electric fencing available. What happens if your horse needs to go on box rest? Or be retricted in some way? I would suggest that it is an essential investment. Does your friend have stables or a barn she could use?
 
Her contract should state how much notice yard owner has to give. Emergency repairs should be the only thing that requires / allows instant access. Are the council YO is sub -letting?
 
I think it depends as well on who has caused the damage. If your friends horses have wrecked stuff & it needs repairing before the next tenant moves in, why should the yo lose income from leaving it empty while its repaired?
