YM giving notice-whos been unresonable?

Hi, im posting under a different name as dont want this linked to my personal account and also want an across the board view of liveries and YMs.

So basicly livery has been given notice. Full notice till end of December.
Livery doesnt want to stay on the yard now as been given notice. So livery moving monday.
Would should livery pay? Full month till end of December? Till end of November? or should Livery get refund on weeks livery till the end of November.

Livery wants refund for week.
Ym has said no refund but not expecting december money either.

PS not a troll just really want opinions of either side and also want personal account to remain annoymous to posssible liveries.
 
I think the YM probably has been quite fair

They could insist on being paid till this time next month I guess

I certainly wouldnt refund the week
 
I agree with YO, no refund. If livery chooses to leave early, they should take the hit.
Generous of the YO to waive the Dec bill if I have understood the post correctly.
 
If the livery pays weekly then a weeks notice. If they pay monthly then they pay for the month.

Its paid monthly, contract in place too. Months notice either way.
Livery is paid up till end of november. Livery wants to leave monday. Ym has said not to pay December but Livery wants refund off livery paid as leaving on Monday and wants refund of money paid for the rest of the week.
 
Depends if contract states otherwise but what YM has said sounds reasonable. I personally wouldn't give the week's refund but also wouldn't expect dec livery. The week that I wouldn't refund would cover me til I could get someone else in-that is one of the reasons for notice periods (from a YM/YO point of view it is,anyway.)
 
Difficult one...

I think it would up to the YO's discretion.

When I have had liveries leave of their own accord, they have just paid up until they date they leave. They have all stayed their 1 mnth notice so no issue of refunds etc.

However I did have to ask a livery to leave and gave her a mnths notice, but she went the following weekend. I only charged her for that week, not the full notice period, as a gesture of goodwill.

Think a lot will depend on the circumstances that the YO has asked the livery to leave, and any contracts in place, and also if they pay in advance or arrears.


Sorry just seen further info - no I would not refund the rest of the week, as being more than reasonable by not charging into Dec.

YM is being more than reasonable, definitely no refund.
 
I would say the YO is being fairly reasonable in saying pay November but not December. I know some yards who would want December paid too.
 
Now you've said it's in the contract that it's a month notice from either party,the livery should go and take the week's hit & think herself lucky-YO being more than reasonable. What makes the livery think she can have/ask for a week's refund when she is actually obliged to pay another 5wks? It is irrelevant that she chooses to leave before the notice expires- that is the livery's choice.
 
Livery should really be paying a months notice, so ym being reasonable. But, if ym has someone ready to pay for box the second livery leaves, then it would be good manners to refund the extra week, rather than getting money from two people for one stable.

Its me thats given the livery notice.
But wants an even view of opinions before i said this.
The livery was given notice this for various reasons i wont go into on here. It just isnt working for me.
I said i was more than happy for them to stay untill the end of december so alternative to be found. But if they wanted to leave before i understood. Lets face it who wants to stay somewhere if theyve been asked to leave??
I said that obviously if they wanted to stay till the end of notice full livery would be payable. I also stated if they were leaving mid month if they gave me a date i would ajust the bill so they payed untill the they left. I did state that if they left before the end of November that they would forfit that weeks money.
I feel ive been more than reasonable. Ive said the horse will get the full proper care whatever and they would be treated fairly as a proper paying customer.
Livery obviously doesnt agree as is moving monday and demanding a weeks money refund and is now sending not particulary nice texts as ive said no.

No livery to move in stable will be empty for the minute till somebody is found to fill it.
 
Stick to your guns - legally they haven't got a leg to stand on, and sadly it sounds like it has got personal.

If they continue trying to bully you, and you have a contract in place, I would then threaten them with the full amount - hopefully that will back them off.

Have been in the same boat and it is not fun, so you have my sympathy......
 
Thankyou feeling slightly better just wanted to check i wasnt been unreasonable as i asked them to leave.
Ive a high suspicion that this happened when they moved to me, as they came at very short notice to me. Claimed they had given notice but new place had fallen through but i now believe they were asked to leave from there.
Im not going to go into why ect. But TBH i would rather the stable be sat empty than the hassle.

You want to see the back of her so in this case I wouldn't argue, just accept things haven't worked out and charge them to the day they leave.
As you were the one to give the notice perhaps it is better to accept in this instance you are going to be out of pocket. Both sides will believe they are in the right so best let things lie..
 
Sorry,I disagree with HH above. She has no one lined up to move into stable&so will be out of pocket anyway(tho,if both sides stuck to the contract,she may not be.) She has waived a month's livery,as a goodwill gesture and acknowledgement that livery will want to leave asap,having been asked to. Livery has come 'out of' the contract somewhat better than the YO,so livery should cut her losses-she accepted contract in first place,so not in a position to push this further.
 
Livery paid in advance? If she wants to leave early, no refund for next week. It's only a week! I got thrown off and left two weeks early. I didn't expect a refund, but I couldn't bear to be on the yard after all the stupidity that had been said so I took the hit and left.

way i look at it yo asks livery to leave yo takes the risk of loosing money not having space filled and therefore takes the hit.
if livery gives notice livery takes the hit.

TBH ive already waived the months notice and about 40 pounds of sevices provided theyve recieved as i couldnt be bothered chasing them for this either as there not great at paying up at the best of times anyway.
I do feel ive been more than fair.

Yer im not expecting them to pay december livery. Although contract states they do. But i knew they would want to leave early so said when i spoke to them about it that they wouldnt have to. I even said if they left part way through december and told be before bill were to be done (monday) that i would ajust there bill accordinly.
But TBH i dont see why i should refund a weeks money.
They had be warned they would have to leave if the reasons i stated werent sorted suitably and they havnt so notice was given. Its there behaviour that has lef me to give notice.
 
I think that you have been perfectly reasonable and fair. If you get any more abusive texts, remind them that, under the contract, you could have charged them for another month, and if they continue to hassle you, you may take legal action to pursue it. Let them stew.

Stick to your guns and ignore the horrible texts, you've been perfectly reasonable, they don't have a leg to stand on.

I've never been asked to leave a yard but I've always paid full notice on the yards when I've left, even though most times it's meant I've paid double for a month because I've wanted to move more quickly. It's just the way it goes.

Your livery should count themselves lucky you aren't chasing for the services owed for and the full notice period. I'd remind them of this and tell them their week's money is forfeit on account of those services and the disruption. Point out that you don't expect to hear from them about this again, unless they'd like you to issue court proceedings for the remaining month owed. It only costs £80 ish to do this online so not a totally unexpected thing to do when it's a few hundred pounds.
