YO relations reach a new and drastic low point - what to do?

Further to the tyre puncturing incident as previously described http://www.horseandhound.co.uk/forums/sh...4&fpart=all , relations with our yard owner have reached the 'critical' state. I told him that I wasn't prepared to pay for a tyre repair until I'd seen the tyre, upon which he produced a tyre with a nail stuck neatly into it. Upon pointing out that the tyre was the incorrect size for the car in question (!!!), things sort of went downhill from there.

Namely that we have 24 hours to move the horses or he will deny us all access to feed and water them, strongly insinuating that he would turf them out onto the main road. Now we have some place to go (mercifully) so we can go.

However, I am curious as to how we stand on this. Is what he is doing illegal? He is currently on parole from jail, secondary to firearms offences...

Think he is treading on very thin ice -but bearing in mind this mans obvious character think it might be better just to go .I would be concerned he might take his 'temper' out on my horse . I would keep a note of all the things he has done/said as you may want to use them later .Think you will be much happier well away from this crook .
 
We are definitely going - I don't have time to waste on this guy anymore. But I am quite curious as to the legality of what he is doing. Namely that unless I pay him £££ for a tyre, he is going to harm my horses and evict me in a way that is completely contrary to our contract and in fact general laws governing landlords evicting tenants. Doesn't that constitute coercion?!!
 
If he's been to prison, he obviously doesn't really take heed of what the law says.

I wouldn't be asking questions, or getting further on the wrong side of him. I'd be hot footing it off asap.

No, not going to move tonight as he is quite paranoid (and I don't use that term loosely, believe me) at the moment and I don't want to be moving stuff around in the dark where he cannot identify me.
 
I can understand how infuriated you must feel but I have to say this is one I would let go. Move your horses to somewhere more friendly (shouldn't be hard

) and put the whole thing behind you. He doesn't exactly sound like a rational human being

If you have a signed contract and he's in breach if it and you can prove it then ou could take it further but I dont see any benefit to you of doing that unless you are losing a sum of money over moving early?? Sounds like a lovely man - NOT, hope you get your horses moved ok :-)
 
if i were you i'd be tempted to try to take a policeman with me when i go to collect the horses tomorrow, if it was me... yes, he's trying to cheat you out of money, and threatening your horses, sounds illegal to me, and as if he won't give a damn either.
 
This is what I would do.

Make ALL your moving arrangements tonight, work out exactly what you are taking and where/how you will take it, gather your passports together and any written contract you have with this man and arrange for a workforce of friends who WILL be available at a set time tomorrow to complete your move in one hit.

NEXT phone the police. Explain the situation to them and tell them you feel this man is threatening your safety and you would like a police presence WHILST you complete your move.

Tomorrow get the heck out of there and dont look back.
 
Actually, I'm not very angry about it - I shall be greatly relieved not be interrupted at work by phonecalls about bits of straw and farriers nails! It is a complete pain in the butt though - he was supposed to be in jail until April by which time I had hoped to complete on the yard I'm buying and then none of this would have happened!!! Bloody parole office!!!
 
Gosh - sounds like you are better off out of there.

If i was you i would just get all your stuff and horses out as soon as possible. If he starts on you in anyway i would ring the police and they could deal with him for breach of the peace at the very least!

A woman of ACTION. Fantastic plan. Where (roughly) are you? pm's from those who can help?
 
Ring the police and tell them the situation, they will escort you and stay with you whilst you gather your belongings and horses.
Also make sure you have a large enough help force to get everything in one hit so you never have to go back.
If you can work out how many people are helping, make sure you have lists of what is where and give each person a list of items they are to collect and they tick them off as they are collected. that way you only have to check the list and do a fast scout around after to make sure everything is accounted for.

Only just read your original post and to be honest I would ring the farrier and tell him/her. Someone said it was not their job to clean up but I do not agree if they shod the horse on the hard standing then yes it is up to them to clean it up if your not there. But I have to say how on earth did you end up on a yard like that? I'd have been gone in a week.

if u have a contract that says he need to give u x amount of days notice to leave then yes he is in breach of his contract, as for tying your horses at road that is 100% illegal as i had a yard owner threatened to do this to mine. he cannot deny your horse food and water as its one of the 5 and I'm assuming you buy your own feed??.

Forget the heavies makes more hassle than its worse and if he has a firearm conviction do u really want friends/relatives and fellow HHO there? Call police say you been thrown of premises due to unproven problems that he is paranoid and has been convicted of firearms and has threatened to harm your horses and you would like then to be there when you move our horses as you are scared for safety of your self and your horses.
 
Kit - have you the lorry space required? I'm north of Cambridge but could bring my lorry over today so you could complete move in fewer runs if you wanted.
 
Sounds like a police matter to me if you can find one, everything he has said done and threatened is fraudulent and illegal, however I would be more concerned with getting my horse/s away from such a dreadfull individual, let us all know when you are sorted so we can all breath a sigh of releif with you

Thanks everyone - we'll see how it all goes today. Have enough box space to move everything in one go so hopefully will get it all sorted.
