I am currently on DIY livery at a medium sized yard. Our indoor arena floor isnt safe to ride on, neither is the surface of our all weather tracks (we have two).

I heard from another livery that one of the horses came in off the track with a nail embedded in his foot!

What would be your stance on this? I am currently in the process of looking for a new yard as this one is over-priced seen as I cannot use the facilities we're meant to be paying for.

I have read about the duty of care a YO has, would our YO be in trouble for this and also what would you do - apart from leave the yard?

Ask for reduced prices whilst waiting to find a new yard?

Your thoughts on this are much appreciated.
 
Why aren't the surfaces safe to ride on?
I don't think one nail could be classed as a failing on duty of care, more likely an unlucky accident.
My gut feeling is that if you don't think you are getting value for money then it is up to you if you wish to leave but that the YO hasn't done much wrong?
 
The surface used on both areas is chopped up window fitters materials...
including amongst others, glass, electrical cable and plastic.
 
Have a word with the YO...... if lots of horses are getting injured then she/he really should do something about it... if it is an isolated incident then just move if your not happy!
 
Thanks. Was wondering if the YO was culpable for any costs should the horses get injured whilst in the school or walk tracks.
I will be leaving post haste!

Surely before moving to the yard you investigated what surface you would be working your horse on??? I wouldn't let my horses within 10 foot of a surface like that and I'm about to pull my horse out of my trainers yard because he has failed to resurface his arena which has become too deep to work on now - I'm not paying 130 a week to ride in a poached field.
 
Having found livery politics not much fun for many years, id be tempted, as someone else said, to keep quiet atm and just leave as soon as you can.

Regarding a nail found in one of the tracks - i doubt that would come under any kind of defecit of care category purely because one nail could have gotten there in literally hundreds of ways.

The surface sounds awful and for me, its one of the main things i look for in a yard (I still remember going and looking round a DIY yard where the owner told me his indoor arena had a solid concrete base with a bit of sand thrown on the top. But it was ok, as there was a cob in there jumping fine at the time! Needless to say, i didnt accept the stable

Resorting to law is the last thing you need to do. There is no certainty that you woul;d win a case. The case could run on for years & additionally you will incur high costs. Invariably the only winner in the court cases are the solicitors representing each party.

As has been said, find yourself another yard & leave.
